IN RE: John A. Gustafson, Plaintiff in Error. vs. The State of Oklahoma, Defendant in Error.
You are advised that the accusation in the above entitled case contains five counts; that the State was permitted by the ruling of the Judge upon demurrer thereto, to present only two of same. That upon those two being all the counts presented to the Jury. John A. Gustafson was found quilty and removed from the office of Chief of Police from the City of Tulsa. Count three of the accusation charged the Defendant with neglect and failure to do his duty in the matter of prosecuting larceny of automobiles for the purpose of collecting rewards for stolen automobiles and procuring unclaimed automobiles which had previously been stolen, and which might come into their possession to be converted and used for their own use and benefit. Count five of the accusation charged the Defendant as follows: That on the night of the 31st. day of May, 1921, and the morning of the 1st. day of June, 1921, various and sundry men and boys of both the white and colored race did travel over and upon the streets of the city of Tulsa, armed with deadly weapons, and did then and there set fire to and burn many buildings, the number of which is to the Grand Jurors unknown, and did with impunity and without molestation commit the crimes of murder, arson, burglary and grand larceny, and the said John A. Gustafson nor any of the policemen under his supervision and control attempted to intercept or prevent the said crimes aforesaid; that the said John
