Albert Herring, of lawful age after being first duly sworn, on oath, states; that he is a resident of the city of Tulsa, Oklahoma and has been for twelve years last past, and was a resident of the city of Tulsa, Oklahoma on the 1st day of June, 1921; Affiant states that on said date, that is the 1st day of June, 1921; he was at work within two blocks of the property of Joe Piro located and situated upon Lot 4 Block 46 of the original town of Tulsa and he saw much burning that was done on said date; affiant states that the property that was burned within his immediate vicinity was set on fire by white persons and that he saw many officers of the law, city officers of the city of Tulsa, Oklahoma from time to time on said date and that he never saw a single one of them make any effort whatsoever to prevent the destruction by fire of the property nor to save that that was set on fire; that the fire Department of the City of Tulsa came out that day and made no effort in that immediate vicinity to save any of the burning property, although houses were burning all around them and that so far as affiant could see, the city officers made no effort to protect property on said date. That the property of the said Joe Piro was burned on said date. Further affiant saith not.
