Henry A. Premer, Deputy Sheriff, Tulsa, Okla., testified:
I attempted to serve a writ of replevin on Bay Ward and the Chief of Police to recover a Buick Roadster for A. O. Burton, of Verne Station; I don't know the exact date; the record will show that. They said they didn't know where the car was and if I could find it, go ahead and find it; I talked to Mr. Murray, of the Bates Adjustment Company, and he said he didn't know anything about the car; that possibly I could find it if I would look around; I said "It is your business to deliver the goods to me if I serve this writ of replevin on you, or take the consequences". He said they would put up a re-delivery bond, which they did that day. Bay Ward admitted to me that they had had possession of the car, but at this time they denied having it; I am not positive, but I believe Bay Ward said the Bates Adjustment Company had the car; I never found the car, and the re-delivery bond ended our work, and I have not looked for it since.
