C. R. Ingersoll, of lawful age, after being first duly sworn, on oath states: That he is a citizen of Tulsa, Tulsa County, Oklahoma, and has been for several years last past and was a resident of said city, County and State on the 1st day of June, 1921; that he saw the fire on the above said date that destroyed so much property in Tulsa, Oklahoma. Affiant states that it is his knowledge and belief that the cause of said fire and the attending destruction was due the gross negligence of the city officials of the city of Tulsa, Oklahoma; that in his judgment the said city officials could have prevented said destructions but that said officials made no effort to do so; that said city officials failed and refused to use its police powers for the purpose of quelling said riot or to stop the property from being burned. And further affiant saith not.
