Nov. 15, 1923. Hon. George F. Short, Attorney General, State Capitol, Oklahoma City, Okla. Dear sir: I represent G. C. Sikes, Ben F. Sikes and Earl Sack, who have filed motions in the District Court of Tulsa County, Oklahoma, to se aside sentences of conviction against them. The motions were originally set for this date. Your office handled the cases, through Mr. C. W. King. On November 7 last I conferred with Mr. King at his office in Oklahoma City with reference to the matter, and was advised that he would be in Washington, D. C. on that date, and that his suggestion was that the motions be set for hearing on November 19. I agreed with Mr. King that the motions should be continued to that date, and that I would protect him in the matter. Upon my return to Tulsa, Mr. Ward, with whom I am associated in the cases states that November 19 would not be agreeable to him, as he would be engaged with other cases on that date. I them inquired of Judge Albert C. Hunt, who is the assignment Judge, whether he would be willing to take the motions up at some time to be agreed upon by all counsel, and he stated that he would. In this situation I am writing you, rather than to Mr. C. W. King, who I take it is absent from the office at this time, with the suggestion that the three motions be heard at some date that will suit the convenience of all counsel, and that the date be suggested at any time hereafter by either your office or us to the other. I am assuming that this will be agreeable, and request that you confirm to me by letter, and that you bring this letter to Mr. King's attention immediately upon his return, so that he not be here on the 19th on account of these motions.
