RESOLUTION WHEREAS, the City of Tulsa, through its Mayor and Board of Commissioners have heretofore made and entered into a contract by and between the City of Tulsa, party of the first part, and Dan A. Burton, Contractor, pary of the second part, for the paving of the Alley in Block 8, Lindsey First Addition to the City of Tulsa, Oklahoma, being from the South line of Ninth Street to the North line of Eleventh Street, and WHEREAS, it is necessary for the health and safety of the citizens in that community that a storm Sewer be constructed in the alley above described for disposing of storm water; and WHEREAS, it is necessary that said storm sewer be constructed prior to the completion of the paving in the alley above described; and WHEREAS, there is not as the present time sufficient funds in the Sewer Department of the City of Tulsa available for the purposes herein provided; and WHEREAS, it is declared to be by the Mayor and Commissioners necessary for the health, safety and best interests of the citizens of the City of Tulsa, residing in that community, and for the best interests of the City of Tulsa, that this emergency storm sewer be constructed at this time. NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF COMMISSIONERS OF THE CITY OF TULSA? OKLAHOMA: That a thirty-(30) inch storm sewer be constructed in the alley in Block 8, Lindsey First Addition, in accordance with the plans and specifications of the City of Tulsa, through the City Engineer's office at a price not to exceed the Engineer's estimate to-wit, $4,339.65, inclusive of the 5% Engineering fee, to-wit: $206.65.
