K. Designated, Undesignated and Other Inflows to Subbasin 5
Both Texas and Oklahoma will have inflows to Subbasin 5 other than Designated and
Undesignated inflows. In many cases the Subbasin 5 boundary is defined by an approved
dam site, at which no dam is to be constructed in the foreseeable future. Designated
and Undesignated inflows are tied to releases of water from storage. Inflows past the
dam site into Subbasin 5 must be "Other inflows," since they have not been released
from storage. Compact Allocation of water in Subbasin 5 is tied to "runoff originating
in subbasin 5 and Undesignated water flowing into subbasin 5." It appears that Other
inflows to Subbasin 5 are not allocated.
It appears that Texas and Oklahoma have two alternatives, i.e., (I) claim all "Other"
inflows to be exempt from the Compact, or (2) claim that these waters can be defined
as "Designated" or "Undesignated," the same as stored waters. The latter best fits my
recollection of the intent of the Engineer Advisors when they drafted the compact
provisions relating to Reach II, Subbasin 5. Therefore, I propose the Engineer Advisors
recommend to the Commission that the "Other" inflows to Subbasin 5 be considered
to be another type of Designated and undesignated inflows. Texas, through its water
right application and approval process, dedicates such inflows at times to serve senior
downstream water rights.
