APPLICATION FOR LEAVE TO FILE PETITION FOR REHEARING
Comes now the plaintiff-in-error, and respectfully shows the court that heretofore, to-wit: on the 29th day of Apri, 1947, a judgment and decision of thsi court was rendered affirming the judgment of the District court of cleveland County in favor of defendants in error and against plaintiff-in-error; that the chief counsel for the plaintiff-in-error reside in New York City and was not sent a copy of the opinion in the cases; that only a copy to the undersigned was sent, and the chief counsel of the plaintiff-in-error were out of their New York office and did not receive a copy of the opinion within the time prescribed by the rules of this court in which a petition-in-error might be filed, and therefore no petition-in-error was filed within the fifteen day period as provided by rule 28 of this court. That the plaintiff-in-error desires and requests leave of the court to file a petition-in-error which is in the course of preparation, and seriously desires to urge the same. WHEREFORE, plaintiff-in-error prays the court of leave to file a petition-in-error within fifteen days from date hereof.
