Blank Page - 1 - SUMMARY Economics The State Treasury deposited $1,318,520.18 into the State General Revenue Fund directly from pari-mutuel wagering taxes from (Fiscal Year) FY-2010, an 19.98% decrease from FY-2009. An additional $13,817,505.07 was deposited to the State General Revenue Fund directly from Gaming Revenue for FY- 2010, a .33% increase from FY-2009, making the total for FY-2010 $15,136,025.25. Total direct collections of $143,336,400.92 from such taxes have been deposited to the State General Revenue Fund since Blue Ribbon Downs, Oklahoma's first pari-mutuel racetrack, began racing on August 30, 1984 (15 months after the Oklahoma Horse Racing Act was implemented). Revenues to the Horse Racing Commission, apart from the pari-mutuel tax during FY-2010, for deposit to the State General Revenue Fund were derived principally from fines, sale of Rule Books, and occupation and organization license fees. In addition, local and county governments, and the State received racing revenues from racetrack admission, sales, and property taxes. Such taxes are collected by the Oklahoma Tax Commission. A detailed accounting of Commission Revenue and Expenditures for FY-2010 is listed at the end of this report. A 2005 study released by the American Horse Council Foundation (AHC) has reported the State horse population at approximately 326,000. As a result of the study conducted by AHC entitled The Economic Impact of the Oklahoma Horse Industry the following information is provided: 1. Oklahoma’s combined horse racing enterprises make up an extremely large and important contribution to the state’s economy. 2. Direct and total effect on Gross Domestic Product (GDP) for horse racing is equal to approximately $220,000,000. 3 42,000 horses are estimated to be involved in Oklahoma race production and use. 4. The Oklahoma Equine Industry involves 118,000 Oklahomans among them 61,000 horse owners. 5. GDP for the combined racetrack production and indirect and induced effects totaled $219 million. Employment estimates suggest that these enterprises account for a combined total of more than 4,200 full-time equivalent jobs. Horse racing activities are only one of several equine-related enterprises in Oklahoma. According to the American Horse Council study, the state horse industry generates 31,600 jobs and an annual economic impact of $1.2 billion. The Oklahoma horse industry was estimated to have a direct and total effect on GDP of $1,248 million during the AHC study period. The AHC study estimated that more than 118,000 Oklahomans are involved in the industry as owners, service providers, employees, and volunteers not including the spectator effect of the industry. - 2 - OVERVIEW OF CY 2010 LEGISLATION ENACTED DURING THE SECOND REGULAR SESSION, 52ND LEGISLATURE THAT IMPACTED THE HORSE RACING INDUSTRY AND/OR HORSE RACING COMMISSION BILLS AMENDING TITLE 3A, OKLAHOMA HORSE RACING ACT SB 820, co-authored by Sen. Jonathan Nichols and Rep. Randy Terrill, amended Section 208.3, Oklahoma Breeding Development Fund Special Account, to add a new purpose for the fund: to provide funding to any non-profit entity exempt from taxation for the purpose of providing care of retired and unwanted Oklahoma- Bred racing stock. The bill also directed the Commission to establish eligibility criteria for a non-profit entity and allowed the Commission to use up to 15% [rather than 10%] of the prior year's receipts into the Oklahoma Breeding Development Fund Special Account for administration of the program. Governor Henry signed the legislation on May 10, 2010. It took effect November 1, 2010. SB 1905, co-authored by Sen. Harry Coates, Sen. Debbe Leftwich and Rep. Don Armes, amended the following four Sections of the Horse Racing Act, requiring that all monies retained or to be distributed for purses at racetracks be held in trust by the Horsemen’s Bookkeeper for the duly designated horsemen’s organization for purses: 205.6: Pari-Mutuel System of Wagering Authorized-Distribution of Funds Retained from Money Wagered-Revenue Bond Financing of Racetrack or Facility Prohibited 205.6a: Offtrack Wagering Plans-Conditions-Notification-Licensing-Breakage and Unclaimed Ticket Proceeds 205.7: Wagering on Out-of-State Races 208.2: Race Meetings Conducted by Fair Associations-Proportions of Wagers Retained-Licenses The bill also added new language to be codified as Section 208.13 to list duties of the Horsemen’s Bookkeeper as follows: Be employed by (1) the racetrack, (2) jointly by two or more racetracks, or (3) an entity contracting with one of more racetracks Maintain records of horsemen, kept separate from the racetrack’s records with funds to be maintained in one or more trust accounts, separate from all other accounts, designated as Horsemen’s Trust Account, and fully insured by the FDIC or FSLIC Receive, maintain and disburse purses with disbursements made within 48 hours of Stewards’ approval unless a protest or appeal has been filed with the Stewards or Commission except for minimum jockey mount fees; and made within 15 days after the last race day of the race meeting Accept, hold or pay monies due and belonging to other organizations, licensees or meeting provided payment or return is made Make all records subject to inspection and audit by the Horse Racing Commission at any time In addition, the Horsemen’s Bookkeeper, racetrack and employer are subject to disciplinary action by the Commission. The Horsemen’s Bookkeeper, employer, and managing officers of each employer are jointly and severally responsible to ensure that the amounts retained from the pari-mutuel handle are distributed according to the Act and Commission orders and rules. Governor Henry signed the legislation on June 6, 2010. It takes effect November 1, 2010. - 3 - LEGISLATION RELATED TO HORSE RACING INDUSTRY HB 3202, authored by Rep. Don Armes and Sen. Mike Schulz, amended the Oklahoma Veterinary Practice Act to address the teeth floating issue by: Adding the definition “teeth floating” to the Oklahoma Veterinary Practice Act Adding language to exclude acts of animal husbandry, such as teeth floating and farriery, from the Act Certifying practitioners of teeth floating to provide non-veterinarian equine dental care with an annual certification fee of $200 Governor Henry signed the legislation on April 16, 2010. It took effect August 26, 2010. LEGISLATION AFFECTING STATE AGENCIES ADMINISTRATIVE RULES HB 2852, co-authored by Rep. John Wright and Sen. Cliff Aldridge, made a number of changes to the Legislature’s part of the rulemaking process, including: Adding definitions of “emergency rule,” “permanent rule” and “substantial evidence” Requiring that emergency rules be approved by the Governor only if the agency provides substantial evidence that it is necessary for one of the following reasons: Protect the public health, safety or welfare Comply with deadlines in amendments to an agency’s governing law or federal programs Avoid violation of federal law or regulation or other state law Avoid imminent reduction to the agency’s budget, or Avoid serious prejudice to the public interest Requiring that, in determining whether a rule meets the emergency measure, the Governor must consider whether the emergency situation was created due to the agency’s delay or inaction and could have been averted by timely compliance with the provisions of the Administrative Procedures Act Updating the requirements for the Rule Impact Statement Requiring that the Governor review the agency’s submission of the emergency rationale separately from the review of the rule Requiring that the Governor approve the emergency rule only if the rule is: Clear, concise and understandable Within the power of the agency to make and within the enacted legislative standards and Made in compliance with the requirements of the Administrative Procedures Act Requiring the Governor, in disapproving an emergency rule, to return the entire document to the agency and make written notification within 15 days to the Speaker of the House of Representatives, the President Pro Tempore of the Senate and the Office of Administrative Rules Requiring the Governor, in approving an emergency rule, to make written notification within 15 days to the agency, Speaker of the House of Representatives, the President Pro Tempore of the Senate and the Office of Administrative Rules - 4 - Requiring the Governor, in disapproving an emergency rule, to return the entire document to the agency and make written notification within 15 days to the Speaker of the House of Representatives, the President Pro Tempore of the Senate and the Office of Administrative Rules Permitting emergency rules to be subject to Legislative review Governor Henry signed the legislation on April 26, 2010. It took effect November 1, 2010. AGENCY WEBSITE HB 2698, co-authored by Rep. Randy McDaniel, Rep. Anatasia Pittman and Sen. Cliff Aldridge, created the Oklahoma Government Website Information Act, requiring public bodies on or before January 1, 2011 to make available on their Internet website or on a general website any administrative rules adopted by the public body; proposed administrative rules; statutes affecting the body and its operations; and any statutes the public may find useful in interacting with the body. Governor Henry signed the legislation on June 6, 2010. It took effect November 1, 2010. APPROPRIATIONS SB 1561 appropriated $2,135,741 to the Horse Racing Commission for FY-2011. This represented a 14% reduction from the FY-2010 appropriations of $2,482,699 [which was a 7% reduction from the FY-2009 appropriations to the Commission]. Governor Henry signed the legislation on June 10, 2010. It took effect July 1, 2010. - 5 - Races, Purses, Incentives Calendar Year (CY) 2010 was the twenty-seventh year of pari-mutuel horse racing in Oklahoma. The Office of the Oklahoma State Auditor and Inspector reports that there were 154,500 official races (-20%) including 152,306 simulcast races (-20%) conducted by the three Commission-sanctioned pari-mutuel racetracks in which $78,579,460.36 (-14%) was wagered. Attendance at organization licensees’ off-Track wagering facilities in Oklahoma is not recorded by the racetracks and therefore not included in the above attendance figure. NOTE: The auditor’s office has been unable to track reliable attendance records from all of the racetracks except FMT. The percentages of change shown above are in relation to CY 2009. Remington Park in Oklahoma City conducted 52,136 races (including 50,994 simulcast races), on which $51,688,794.80 was wagered. That amount includes wagering from Off Track Wagering facilities as well as all simulcast races. During 116 days of live racing, $27,057,022.50 was wagered and during 249 simulcasting only days $24,631,772.40 was wagered. At the Off-track Wagering facilities, $21,050,795.55 was wagered. Horsemen at Remington Park ran for purses and stakes of $23,823,636.00, which included nomination fees, in CY 2010. The balance of purses earned consisted of $2,118,510.00 in Oklahoma-Bred purse supplements. Broodmares were awarded $1,356,187.00 and Stallions were awarded $557,565.00 from the Oklahoma-Bred Program. The Tulsa County Public Facilities Authority at Tulsa conducted 39,790 races (including 39,378 simulcast races) on which $21,766,978.35 was wagered. During 34 days of live racing, $4,114,639.70 was wagered and during 284 simulcasting only days $17,652,338.65 was wagered. Horsemen at Fair Meadows at Tulsa ran for purses and stakes of $3,562,987.00, which included nomination fees. The balance of purses earned consisted $319,645.00 in Oklahoma-Bred purse supplements. Broodmares were awarded $209,425.00 and Stallions were awarded $78,787.00 from the Oklahoma-Bred Program. Will Rogers Downs in Claremore conducted 62,574 races (including 61,934 simulcast races) on which $5,123,687.11 was wagered. During 59 days of live racing, $2,368,990.51 was wagered and during 306 simulcasting only days $2,754,696.60 was wagered. Horsemen at Will Rogers Downs ran for purses and stakes of $7,922,864.00. The balance of purses earned consisted of $667,980.00 in Oklahoma-Bred purse supplements. Broodmares were awarded $434,502.00 and Stallions were awarded $159,859.00 from the Oklahoma-Bred Program. Combined purses and stakes (including Oklahoma-Bred purse supplements) earned during CY 2010 at the three Commission-licensed racetracks totaled $38,415,622.00. A strong incentive to horse breeding in the State was provided through purse supplement awards totaling $3,106,135.00 from the Oklahoma Breeding Development Fund Special Account earned by accredited Oklahoma-Bred racing stock at Commission-licensed pari-mutuel facilities during CY 2010. Broodmare awards earned totaled $2,000,114.00 and Stallion awards earned totaled $798,211.00 (including the Stallion Escrow awards of $84,596.00) for a total distribution of $5,987,036.00 for calendar year 2010. - 6 - REPORT This report reviews general activities of the Oklahoma Horse Racing Commission during CY 2010 and fiscal activities during FY 2010 (July 1, 2009, through June 30, 2010). Introduction State Question 553 (Initiative Petition 315) adopted at an election held on September 21, 1982, authorized the pari-mutuel system of wagering on horse races in Oklahoma. The Oklahoma Horse Racing Act, Title 3A, Chapter 2 of the Oklahoma Statutes, was enacted with an Emergency Provision and became effective March 22, 1983. The State-Tribal Gaming Act became effective after State Question 712 on November 2, 2004. Provisions SB 1058 increased the Commission from seven to nine members who are appointed by the Governor with confirmation by the State Senate for six-year terms. Initial appointments allowed for two-year staggered terms. During 2010, Commissioners and their terms were as follows: Terms Expiring June 30, 2011 Cassie Barkett, Congressional District 1 Patrick Grimmett, Congressional District 3 Melvin Bollenbach, At Large Terms Expiring June 30, 2013 Terms Expiring June 30, 2015 Wayne Carter, Congressional District 2 Jim Bowers, Congressional District 4 Malcolm Savage, Congressional District 5 Becky Goumaz, Congressional District 3 John Smicklas, At Large Brandon Burton, Congressional District 5 The Oklahoma Horse Racing Act provides that horse racing under the pari-mutuel system of wagering may be authorized by a majority of voters in a county voting in an election called for that purpose. At least fifteen such elections have been held. Voters in twelve counties have voted to authorize pari-mutuel horse racing (Beckham, Comanche, Creek, Garfield, Lincoln, Love, Marshall, Oklahoma, Okmulgee, Rogers, Sequoyah, and Tulsa). Voters in Atoka County voted once not to authorize, and voters in Carter County voted twice not to authorize. The Oklahoma Horse Racing Commission has plenary power to promulgate rules and regulations for the forceful control of race meetings held in the State so as to: 1. Encourage agriculture and the breeding of horses in this State; and 2. Maintain race meetings held in this State of the highest quality and free of any horse racing practices which are corrupt, incompetent, dishonest, or unprincipled; and 3. Dissipate any cloud of association with the undesirable and maintain the appearance as well as the fact of complete honesty and integrity of horse racing in this State; and 4. Generate public revenues. - 7 - OPERATIONS Policy Policy is established by the Commission. The Commission held eight monthly meetings during CY 2010. Administration The Commission maintains its principal office at 2401 N.W. 23rd Street, Suite 78, Oklahoma City, Oklahoma, 73107. In addition, the Commission maintains license offices at each of the licensed racetracks. Commission operations were administered through Constantin Rieger, Executive Director. Other agencies of State government which have direct involvement in Commission operations are the Office of the Attorney General, the Oklahoma State Bureau of Investigation, the Oklahoma Bureau of Narcotics, the Department of Central Services, the Oklahoma Tax Commission, the Office of State Finance, the Office of Personnel Management, the Alcoholic Beverage Laws Enforcement Commission, the Office of the State Auditor and Inspector, and the Office of the State Fire Marshal. There were 29.16 full-time employees (FTE) and 10.03 permanent part-time employees (PPTE) or 39.19 employment positions utilized by the Commission during FY- 2010. In addition to full-time employees, the functions of the Commission’s permanent part-time employees are briefly described below: Stewards: Three Stewards are appointed to be present at each licensed racetrack as a Board of Stewards to supervise and judge all matters of fact with respect to the conduct of a race meeting and file reports with the Commission. They are employees of the Commission and responsible ultimately to the Commission. - 8 - Official Veterinarian: One Doctor of Veterinary Medicine (D.V.M.) is appointed by the Commission at each racetrack and is an employee of the Commission. The Official Veterinarian determines which horses are deemed unsafe or unsound to run; supervises the taking of equine urine and blood samples for drug testing; supervises the Veterinarian Assistant, the Racing Veterinarian, Test Barn Assistants, Test Barn Escorts, and licensed veterinarians practicing within the enclosure; and treats horses in the event of an emergency. Veterinary Assistant: One Veterinary Assistant is on duty in the Test Barn at Remington Park and Fair Meadows at Tulsa on allotted race days and other assigned days to provide support services for the Official Veterinarian. Horse Identifier: One Horse Identifier is employed by the Commission at each racetrack to ensure proper identification of all horses starting in a race and to file race reports with the Commission. Licensing Personnel: One Chief Clerk and Assistant Clerk(s) are on duty at license offices at a racetrack on allotted race days and other assigned days to fingerprint applicants and to issue and verify occupation licenses which entitle persons to own, train and ride horses and to perform in other occupations within the racing enclosure. Some 32 classes of licenses were issued (e.g., Owners, Trainers, Owner/Trainers, Jockeys, Grooms, Mutuel Clerks, and Vendors). In addition, the Commission processed 1,125 multiple ownership registrations. Occupation licenses are issued annually except that certain license categories (Owner, Trainer, Owner/Trainer, Jockey, Apprentice Jockey, Blacksmith, and Veterinarian) may purchase triennial licenses (licenses valid for three years). Two FTE licensing personnel were employed in the main Commission office during 2010. In addition to processing all license applications including those received by mail, these staff members made all computer licensing database entries. In order to better serve horsemen and racing in general, these FTE licensing personnel occasionally assisted in licensing offices at the racetracks. The Racing Commissioners International (RCI), consisting of fifty-two member jurisdictions and seven associate members, maintains a computer-based information service. This information is accessible to the Commission through a secured Internet website. The file contains the names, addresses, other identifying characteristics, and racing rule violation records of persons who have been issued occupation licenses by the RCI member jurisdictions. Since 1984, the Commission has entered Oklahoma data on license issuances, denials, suspensions, revocations and fines into such a computer file. In this way, data are brought together for occupation licensees from participating racing jurisdictions which enable the jurisdictions to better maintain the integrity of racing through reciprocity acknowledgment of a licensee's racing record. Commission license offices at the racetracks utilizes intranet and internet computer programs which enables retrieval of license information on a 24-hour basis from the main license database at the Commission office in Oklahoma City and from the RCI database. It is also possible to link a specific license with other areas of activity in which a person may be involved, such as lease agreements, multiple ownerships, or dual licenses. The Oklahoma Horse Racing Act and the organizational plan adopted by the Commission provides for a Law Enforcement Division which is responsible for conducting investigations relating to the proper conduct of horse racing and the pari-mutuel system of wagering, including but not limited to barring undesirables from horse racing, undercover investigations, fingerprinting persons licensed by the Commission, and reviewing license applications. Agent then makes additional reports as required and processes evidence. OHRC Law Enforcement Agent receives information on an incident, takes notes & makes report on proper form, Files report with OHRC LED Director. Agent compiles reports and evidence and consults with the OHRC LED Director in regards to requesting a hearing for rule violations. Agent notifies outside Law Enforcement When either Agents or Track Agency, if applicable Security are witness to a violation or have evidence of a violation requiring emergency action, they advise the Board of Stewards immediately and request summary suspension. Records Records Safe Keeping/ Processing If approved by OHRC LED Director, Agent fills out Stewards’ Hearing Request, Witness Information sheet and files them, along with original reports and case file, with the Board of Stewards. If there is a possible violation of Statutes, Agent presents the case to the proper District Attorney for filing. If a criminal case is filed, the Agent follows up by testifying and presenting evidence at trial. Agent checks cases for disposition and takes appropriate action on convictions Agent may be required to present evidence at Appeal Hearing. Agent disposes of evidence according to State Law. Agent follows up by testifying and presenting evidence at hearing - 14 - Race Meetings Except as otherwise provided by Commission rule, applications from organization licensees or applications for Original Organization License requesting race days are required to be received by the Commission by June 1 of a given year to conduct race meetings in the following calendar year. The Commission allotted 211 live pari-mutuel race days for calendar 2010. Applications for Organization Licenses to Conduct Pari-Mutuel Racing and Simulcasting in 2010 The Commission received, investigated, conducted public hearings as required, deliberated and made determinations regarding applications from the following pari-mutuel organization license applicants to conduct live race meetings and simulcasting during CY 2010. 1. Remington Park, Inc., (RP), in Oklahoma County, was granted a Conditional Organization License and allotted 117 live race days for two race meetings in Oklahoma City during 2010, as follows: a Quarter Horse, Appaloosa, and Paint Race Meeting (50 live race days), and a Thoroughbred Meeting (67 live race days). 2.. Upon dissolution of the OCPDL equine drug testing program, Truesdail Laboratories, located in Tustin, California, being the successful state primary laboratory contract bidder, began performing these drug tests effective July 1, 2001. Beginning July 1, 2005, Industrial Laboratories of Wheat Ridge, Colorado, became the OHRC primary lab. Texas A & M, University of Pennsylvania, Louisiana State University and the Michigan Department of Agriculture perform split sample drug testing. Pursuant to provisions of the Oklahoma Horse Racing Act, the Oklahoma-Bred Program is administered by the Commission and is the State of Oklahoma's financial incentive to the breeding and racing of accredited Oklahoma-Bred horses. The Commission authorizes the types and minimum number of accredited Oklahoma-Bred races, as well as the amounts of added purse money and stallion and broodmare awards paid to recipients. The Program is funded through revenue generated by all breakage and unclaimed ticket proceeds from wagering handle, and from a direct percentage of wagering handle, funds generated pursuant to Legislation enacted in 1991 (SB 198) and continued in 1995 through the provisions of SB 111. Senate Bill 198 and Senate Bill 111 reduced the State's tax percentage of takeout from wagering handle and increased the percentage to horsemen's purses and to the Oklahoma-Bred Program. The seventeenth full year in which additional purse funds were generated in accordance with this legislation was in 2010. All Oklahoma-Bred Program proceeds are remitted directly to the Commission for deposit with the Office of the State Treasurer to the credit of the Oklahoma Breeding Development Fund Special Account. Since the first Oklahoma-Bred race was run on August 30, 1984 and through CY 2010, the Commission has paid added purse money, and stallion and broodmare awards amounting to approximately $57.7 million to eligible owners of accredited Oklahoma-Bred racing stock, broodmares, and stallions. The Commission assumed the duties and functions of the official Registering Agency by electing to bring the Oklahoma-Bred registration process in-house and off state bid contract effective January 1, 1992. The Registering Agency registers accredited Oklahoma-Bred racing stock, stallions, and broodmares for eligibility to receive purse supplements and stallion and broodmare awards as authorized by the Commission from the proceeds of the Oklahoma Breeding Development Fund Special Account. Registration fees for horses in the Oklahoma-Bred Program, which are among the lowest in the nation, are set by Commission rule and were deposited by the Commission into the State General Fund through June 30, 1999. SB 1365 amended 3A O.S. § 208.3 to provide that the registration fees be deposited into the Oklahoma Breeding Development Fund Special Account, effective July 1, 1999. 33 - The Commission’s Oklahoma-Bred registration department, the official Registering Agency, receives registration applications, reviews each application for completeness and eligibility, and subsequently registers qualifying horses into the Program. The Registering Agency also keeps abreast of current breed registries' requirements (Quarter horse, Thoroughbred, Paint, Appaloosa, Arabian, and Pinto). During CY 2010, 3,219 horses were registered into the Oklahoma-Bred Program and during FY-2010 $207,288 (compared to $251,200 in FY-2009) in Oklahoma-Bred registration and ownership transfer fees were collected by the Commission and deposited to the Oklahoma Breeding Development Fund Special Account. Of the horses registered into the Oklahoma-Bred Program during 2010, 2,100 were Racing Stock, 1,044 were Broodmares and 75 were Stallions. All payments from the Oklahoma Breeding Development Fund Special Account to breeders and owners are made by the Commission, as has been the case since 1984. Upon receipt of race day reports from the Commission, the Registering Agency verifies the accredited Oklahoma-Bred eligibility of win, place, and show racing stock and of broodmares and sires of those horses. Upon final Commission verification, claims for the authorized amount of purse supplements, stallion and broodmare awards are prepared by Commission staff; and state vouchers (checks) are distributed by the Commission directly to eligible recipient owners and breeders. During 2010, the Commission processed 8,370 checks to eligible recipient owners and breeders. Initial assessment of eligibility is made. Registry returns fees & documents if ineligible. For Broodmare & Stallions, owner has one year in which to complete registration, otherwise, application is rejected with no refund of fee. Racing Stock owner has until December 31 of the horses three-year-old year to complete registration, otherwise, application is rejected with no refund of fee. Data entry is done for all Oklahoma-Bred registered horses; files are kept in numerical order, regardless of Breed, age, sex, etc. Horse is entered into approved race and finishes in position for which Oklahoma- Bred added purse supplement, Broodmare and/or Stallion awards have been authorized. Oklahoma-Bred Registry receives copy of official race program from Claims Department; verifies eligibility of horses for Oklahoma-Bred monies. Registry prepares and proofs Oklahoma-Bred award chart. Completed chart is forwarded to claims Department for processing of payment. File for each horse eligible for Oklahoma-Bred awards for appropriate race is pulled; Oklahoma- Bred awards charts are prepared, indicating racetrack, race date, race type, race number, track purse and Oklahoma-Bred purse supplement. Chart also details all pertinent information pertaining to each horse in order to correctly pay rightful owner of racing stock, Broodmare and Stallion. Registry staff maintains Oklahoma- Bred files on a daily basis and updates files on an as-needed basis. If horse’s file does not contain correct information and/or documentation, a “hold” is placed on Oklahoma-Bred awards and notice is sent to rightful recipient of award. Notice indicates what information/documentation is required in order to release the “hold” on awards. A notice of release of hold on Oklahoma-Bred awards is prepared and forwarded to Claims. - 40 - OKLAHOMA-BRED PROGRAM – CLAIMS PROCESS FLOW CHART Copies of official Stewards’ programs are faxed to Claims Department to begin initial claims process. Approved race for which Oklahoma- Bred added purse supplement, Broodmare and/or Stallion awards have been authorized. Stewards declare race is official. Statistical information on each approved race for which Oklahoma-Bred monies have been authorized is entered in to appropriate spreadsheets. Information concerning each Racing Stock, Broodmare and Stallion is entered into the Oklahoma-Bred Claims database. Charts and official programs are returned to Claims Department for W-9 and check processing. Copy of official program is forwarded to Oklahoma-Bred Registering Agency for verification of eligibility and charting. Report is generated to determine if an eligible recipient needs to file an IRS W-9 with Claims Department. IRS W-9 form is mailed to eligible recipient, if needed. If IRS W-9 form is on file, Claims Department begins check process. Information pertaining to possible drug infractions is obtained from Law Enforcement Division. Positive drug tests in a race are placed on “hold”. If Negative drug test, the race is released for payment to eligible participants. Two authorized signatures are required for each check. Checks are printed, proofed and corrected, if necessary. Check Report is generated, proofed and corrected, if necessary. Check information is copied into text file and transferred to the State Treasurer’s Office. Check numbers are entered into Oklahoma-Bred Claims database. Checks are sorted, proofed and corrected if necessary. Checks are prepared for mailing. Spreadsheets for each Race Meeting are updated with race and payment information. The Office of State Auditor and Inspector conducts the audit of the Oklahoma Breeding Development Fund Special Account and Agency Audit. The Office of the State Auditor and Inspector inspects pari-mutuel wagering machines and audits the distribution of pari-mutuel wagering handle procedures at Commission-licensed racetracks and Off-Track Wagering Facilities on behalf of the Horse Racing Commission and furnishes reports to the Commission. The Tax Commission collects pari-mutuel taxes and sales taxes due the State directly from the racetracks and provides official reports (excepting sales tax information) to the Horse Racing Commission.

Blank Page - 1 - SUMMARY Economics The State Treasury deposited $1,318,520.18 into the State General Revenue Fund directly from pari-mutuel wagering taxes from (Fiscal Year) FY-2010, an 19.98% decrease from FY-2009. An additional $13,817,505.07 was deposited to the State General Revenue Fund directly from Gaming Revenue for FY- 2010, a .33% increase from FY-2009, making the total for FY-2010 $15,136,025.25. Total direct collections of $143,336,400.92 from such taxes have been deposited to the State General Revenue Fund since Blue Ribbon Downs, Oklahoma's first pari-mutuel racetrack, began racing on August 30, 1984 (15 months after the Oklahoma Horse Racing Act was implemented). Revenues to the Horse Racing Commission, apart from the pari-mutuel tax during FY-2010, for deposit to the State General Revenue Fund were derived principally from fines, sale of Rule Books, and occupation and organization license fees. In addition, local and county governments, and the State received racing revenues from racetrack admission, sales, and property taxes. Such taxes are collected by the Oklahoma Tax Commission. A detailed accounting of Commission Revenue and Expenditures for FY-2010 is listed at the end of this report. A 2005 study released by the American Horse Council Foundation (AHC) has reported the State horse population at approximately 326,000. As a result of the study conducted by AHC entitled The Economic Impact of the Oklahoma Horse Industry the following information is provided: 1. Oklahoma’s combined horse racing enterprises make up an extremely large and important contribution to the state’s economy. 2. Direct and total effect on Gross Domestic Product (GDP) for horse racing is equal to approximately $220,000,000. 3 42,000 horses are estimated to be involved in Oklahoma race production and use. 4. The Oklahoma Equine Industry involves 118,000 Oklahomans among them 61,000 horse owners. 5. GDP for the combined racetrack production and indirect and induced effects totaled $219 million. Employment estimates suggest that these enterprises account for a combined total of more than 4,200 full-time equivalent jobs. Horse racing activities are only one of several equine-related enterprises in Oklahoma. According to the American Horse Council study, the state horse industry generates 31,600 jobs and an annual economic impact of $1.2 billion. The Oklahoma horse industry was estimated to have a direct and total effect on GDP of $1,248 million during the AHC study period. The AHC study estimated that more than 118,000 Oklahomans are involved in the industry as owners, service providers, employees, and volunteers not including the spectator effect of the industry. - 2 - OVERVIEW OF CY 2010 LEGISLATION ENACTED DURING THE SECOND REGULAR SESSION, 52ND LEGISLATURE THAT IMPACTED THE HORSE RACING INDUSTRY AND/OR HORSE RACING COMMISSION BILLS AMENDING TITLE 3A, OKLAHOMA HORSE RACING ACT SB 820, co-authored by Sen. Jonathan Nichols and Rep. Randy Terrill, amended Section 208.3, Oklahoma Breeding Development Fund Special Account, to add a new purpose for the fund: to provide funding to any non-profit entity exempt from taxation for the purpose of providing care of retired and unwanted Oklahoma- Bred racing stock. The bill also directed the Commission to establish eligibility criteria for a non-profit entity and allowed the Commission to use up to 15% [rather than 10%] of the prior year's receipts into the Oklahoma Breeding Development Fund Special Account for administration of the program. Governor Henry signed the legislation on May 10, 2010. It took effect November 1, 2010. SB 1905, co-authored by Sen. Harry Coates, Sen. Debbe Leftwich and Rep. Don Armes, amended the following four Sections of the Horse Racing Act, requiring that all monies retained or to be distributed for purses at racetracks be held in trust by the Horsemen’s Bookkeeper for the duly designated horsemen’s organization for purses: 205.6: Pari-Mutuel System of Wagering Authorized-Distribution of Funds Retained from Money Wagered-Revenue Bond Financing of Racetrack or Facility Prohibited 205.6a: Offtrack Wagering Plans-Conditions-Notification-Licensing-Breakage and Unclaimed Ticket Proceeds 205.7: Wagering on Out-of-State Races 208.2: Race Meetings Conducted by Fair Associations-Proportions of Wagers Retained-Licenses The bill also added new language to be codified as Section 208.13 to list duties of the Horsemen’s Bookkeeper as follows: Be employed by (1) the racetrack, (2) jointly by two or more racetracks, or (3) an entity contracting with one of more racetracks Maintain records of horsemen, kept separate from the racetrack’s records with funds to be maintained in one or more trust accounts, separate from all other accounts, designated as Horsemen’s Trust Account, and fully insured by the FDIC or FSLIC Receive, maintain and disburse purses with disbursements made within 48 hours of Stewards’ approval unless a protest or appeal has been filed with the Stewards or Commission except for minimum jockey mount fees; and made within 15 days after the last race day of the race meeting Accept, hold or pay monies due and belonging to other organizations, licensees or meeting provided payment or return is made Make all records subject to inspection and audit by the Horse Racing Commission at any time In addition, the Horsemen’s Bookkeeper, racetrack and employer are subject to disciplinary action by the Commission. The Horsemen’s Bookkeeper, employer, and managing officers of each employer are jointly and severally responsible to ensure that the amounts retained from the pari-mutuel handle are distributed according to the Act and Commission orders and rules. Governor Henry signed the legislation on June 6, 2010. It takes effect November 1, 2010. - 3 - LEGISLATION RELATED TO HORSE RACING INDUSTRY HB 3202, authored by Rep. Don Armes and Sen. Mike Schulz, amended the Oklahoma Veterinary Practice Act to address the teeth floating issue by: Adding the definition “teeth floating” to the Oklahoma Veterinary Practice Act Adding language to exclude acts of animal husbandry, such as teeth floating and farriery, from the Act Certifying practitioners of teeth floating to provide non-veterinarian equine dental care with an annual certification fee of $200 Governor Henry signed the legislation on April 16, 2010. It took effect August 26, 2010. LEGISLATION AFFECTING STATE AGENCIES ADMINISTRATIVE RULES HB 2852, co-authored by Rep. John Wright and Sen. Cliff Aldridge, made a number of changes to the Legislature’s part of the rulemaking process, including: Adding definitions of “emergency rule,” “permanent rule” and “substantial evidence” Requiring that emergency rules be approved by the Governor only if the agency provides substantial evidence that it is necessary for one of the following reasons: Protect the public health, safety or welfare Comply with deadlines in amendments to an agency’s governing law or federal programs Avoid violation of federal law or regulation or other state law Avoid imminent reduction to the agency’s budget, or Avoid serious prejudice to the public interest Requiring that, in determining whether a rule meets the emergency measure, the Governor must consider whether the emergency situation was created due to the agency’s delay or inaction and could have been averted by timely compliance with the provisions of the Administrative Procedures Act Updating the requirements for the Rule Impact Statement Requiring that the Governor review the agency’s submission of the emergency rationale separately from the review of the rule Requiring that the Governor approve the emergency rule only if the rule is: Clear, concise and understandable Within the power of the agency to make and within the enacted legislative standards and Made in compliance with the requirements of the Administrative Procedures Act Requiring the Governor, in disapproving an emergency rule, to return the entire document to the agency and make written notification within 15 days to the Speaker of the House of Representatives, the President Pro Tempore of the Senate and the Office of Administrative Rules Requiring the Governor, in approving an emergency rule, to make written notification within 15 days to the agency, Speaker of the House of Representatives, the President Pro Tempore of the Senate and the Office of Administrative Rules - 4 - Requiring the Governor, in disapproving an emergency rule, to return the entire document to the agency and make written notification within 15 days to the Speaker of the House of Representatives, the President Pro Tempore of the Senate and the Office of Administrative Rules Permitting emergency rules to be subject to Legislative review Governor Henry signed the legislation on April 26, 2010. It took effect November 1, 2010. AGENCY WEBSITE HB 2698, co-authored by Rep. Randy McDaniel, Rep. Anatasia Pittman and Sen. Cliff Aldridge, created the Oklahoma Government Website Information Act, requiring public bodies on or before January 1, 2011 to make available on their Internet website or on a general website any administrative rules adopted by the public body; proposed administrative rules; statutes affecting the body and its operations; and any statutes the public may find useful in interacting with the body. Governor Henry signed the legislation on June 6, 2010. It took effect November 1, 2010. APPROPRIATIONS SB 1561 appropriated $2,135,741 to the Horse Racing Commission for FY-2011. This represented a 14% reduction from the FY-2010 appropriations of $2,482,699 [which was a 7% reduction from the FY-2009 appropriations to the Commission]. It took effect July 1, 2010. - 5 - Races, Purses, Incentives Calendar Year (CY) 2010 was the twenty-seventh year of pari-mutuel horse racing in Oklahoma. The Office of the Oklahoma State Auditor and Inspector reports that there were 154,500 official races (-20%) including 152,306 simulcast races (-20%) conducted by the three Commission-sanctioned pari-mutuel racetracks in which $78,579,460.36 (-14%) was wagered. Attendance at organization licensees’ off-Track wagering facilities in Oklahoma is not recorded by the racetracks and therefore not included in the above attendance figure. NOTE: The auditor’s office has been unable to track reliable attendance records from all of the racetracks except FMT. The percentages of change shown above are in relation to CY 2009. Remington Park in Oklahoma City conducted 52,136 races (including 50,994 simulcast races), on which $51,688,794.80 was wagered. That amount includes wagering from Off Track Wagering facilities as well as all simulcast races. During 116 days of live racing, $27,057,022.50 was wagered and during 249 simulcasting only days $24,631,772.40 was wagered. At the Off-track Wagering facilities, $21,050,795.55 was wagered. Horsemen at Remington Park ran for purses and stakes of $23,823,636.00, which included nomination fees, in CY 2010. The balance of purses earned consisted of $2,118,510.00 in Oklahoma-Bred purse supplements. Broodmares were awarded $1,356,187.00 and Stallions were awarded $557,565.00 from the Oklahoma-Bred Program. The Tulsa County Public Facilities Authority at Tulsa conducted 39,790 races (including 39,378 simulcast races) on which $21,766,978.35 was wagered. During 34 days of live racing, $4,114,639.70 was wagered and during 284 simulcasting only days $17,652,338.65 was wagered. Horsemen at Fair Meadows at Tulsa ran for purses and stakes of $3,562,987.00, which included nomination fees. The balance of purses earned consisted $319,645.00 in Oklahoma-Bred purse supplements. Broodmares were awarded $209,425.00 and Stallions were awarded $78,787.00 from the Oklahoma-Bred Program. Will Rogers Downs in Claremore conducted 62,574 races (including 61,934 simulcast races) on which $5,123,687.11 was wagered. During 59 days of live racing, $2,368,990.51 was wagered and during 306 simulcasting only days $2,754,696.60 was wagered. Horsemen at Will Rogers Downs ran for purses and stakes of $7,922,864.00. The balance of purses earned consisted of $667,980.00 in Oklahoma-Bred purse supplements. Broodmares were awarded $434,502.00 and Stallions were awarded $159,859.00 from the Oklahoma-Bred Program. Combined purses and stakes (including Oklahoma-Bred purse supplements) earned during CY 2010 at the three Commission-licensed racetracks totaled $38,415,622.00. A strong incentive to horse breeding in the State was provided through purse supplement awards totaling $3,106,135.00 from the Oklahoma Breeding Development Fund Special Account earned by accredited Oklahoma-Bred racing stock at Commission-licensed pari-mutuel facilities during CY 2010. Broodmare awards earned totaled $2,000,114.00 and Stallion awards earned totaled $798,211.00 (including the Stallion Escrow awards of $84,596.00) for a total distribution of $5,987,036.00 for calendar year 2010. - 6 - REPORT This report reviews general activities of the Oklahoma Horse Racing Commission during CY 2010 and fiscal activities during FY 2010 (July 1, 2009, through June 30, 2010). Introduction State Question 553 (Initiative Petition 315) adopted at an election held on September 21, 1982, authorized the pari-mutuel system of wagering on horse races in Oklahoma. The Oklahoma Horse Racing Act, Title 3A, Chapter 2 of the Oklahoma Statutes, was enacted with an Emergency Provision and became effective March 22, 1983. The State-Tribal Gaming Act became effective after State Question 712 on November 2, 2004. Provisions SB 1058 increased the Commission from seven to nine members who are appointed by the Governor with confirmation by the State Senate for six-year terms. Initial appointments allowed for two-year staggered terms. At least fifteen such elections have been held. Voters in twelve counties have voted to authorize pari-mutuel horse racing (Beckham, Comanche, Creek, Garfield, Lincoln, Love, Marshall, Oklahoma, Okmulgee, Rogers, Sequoyah, and Tulsa). Voters in Atoka County voted once not to authorize, and voters in Carter County voted twice not to authorize. The Oklahoma Horse Racing Commission has plenary power to promulgate rules and regulations for the forceful control of race meetings held in the State so as to: 1. Encourage agriculture and the breeding of horses in this State; and 2. Maintain race meetings held in this State of the highest quality and free of any horse racing practices which are corrupt, incompetent, dishonest, or unprincipled; and 3. Dissipate any cloud of association with the undesirable and maintain the appearance as well as the fact of complete honesty and integrity of horse racing in this State; and 4. Generate public revenues. - 7 - OPERATIONS Policy Policy is established by the Commission. The Commission held eight monthly meetings during CY 2010. Administration The Commission maintains its principal office at 2401 N.W. 23rd Street, Suite 78, Oklahoma City, Oklahoma, 73107. In addition, the Commission maintains license offices at each of the licensed racetracks. Commission operations were administered through Constantin Rieger, Executive Director. Other agencies of State government which have direct involvement in Commission operations are the Office of the Attorney General, the Oklahoma State Bureau of Investigation, the Oklahoma Bureau of Narcotics, the Department of Central Services, the Oklahoma Tax Commission, the Office of State Finance, the Office of Personnel Management, the Alcoholic Beverage Laws Enforcement Commission, the Office of the State Auditor and Inspector, and the Office of the State Fire Marshal. There were 29.16 full-time employees (FTE) and 10.03 permanent part-time employees (PPTE) or 39.19 employment positions utilized by the Commission during FY- 2010. In addition to full-time employees, the functions of the Commission’s permanent part-time employees are briefly described below: Stewards: Three Stewards are appointed to be present at each licensed racetrack as a Board of Stewards to supervise and judge all matters of fact with respect to the conduct of a race meeting and file reports with the Commission. They are employees of the Commission and responsible ultimately to the Commission. - 8 - Official Veterinarian: One Doctor of Veterinary Medicine (D.V.M.) is appointed by the Commission at each racetrack and is an employee of the Commission. The Official Veterinarian determines which horses are deemed unsafe or unsound to run; supervises the taking of equine urine and blood samples for drug testing; supervises the Veterinarian Assistant, the Racing Veterinarian, Test Barn Assistants, Test Barn Escorts, and licensed veterinarians practicing within the enclosure; and treats horses in the event of an emergency. Veterinary Assistant: One Veterinary Assistant is on duty in the Test Barn at Remington Park and Fair Meadows at Tulsa on allotted race days and other assigned days to provide support services for the Official Veterinarian. Horse Identifier: One Horse Identifier is employed by the Commission at each racetrack to ensure proper identification of all horses starting in a race and to file race reports with the Commission. Licensing Personnel: One Chief Clerk and Assistant Clerk(s) are on duty at license offices at a racetrack on allotted race days and other assigned days to fingerprint applicants and to issue and verify occupation licenses which entitle persons to own, train and ride horses and to perform in other occupations within the racing enclosure. Some 32 classes of licenses were issued (e.g., Owners, Trainers, Owner/Trainers, Jockeys, Grooms, Mutuel Clerks, and Vendors). In addition, the Commission processed 1,125 multiple ownership registrations. Occupation licenses are issued annually except that certain license categories (Owner, Trainer, Owner/Trainer, Jockey, Apprentice Jockey, Blacksmith, and Veterinarian) may purchase triennial licenses (licenses valid for three years). Two FTE licensing personnel were employed in the main Commission office during 2010. In addition to processing all license applications including those received by mail, these staff members made all computer licensing database entries. In order to better serve horsemen and racing in general, these FTE licensing personnel occasionally assisted in licensing offices at the racetracks. The Racing Commissioners International (RCI), consisting of fifty-two member jurisdictions and seven associate members, maintains a computer-based information service. This information is accessible to the Commission through a secured Internet website. The file contains the names, addresses, other identifying characteristics, and racing rule violation records of persons who have been issued occupation licenses by the RCI member jurisdictions. Since 1984, the Commission has entered Oklahoma data on license issuances, denials, suspensions, revocations and fines into such a computer file. In this way, data are brought together for occupation licensees from participating racing jurisdictions which enable the jurisdictions to better maintain the integrity of racing through reciprocity acknowledgment of a licensee's racing record. Commission license offices at the racetracks utilizes intranet and internet computer programs which enables retrieval of license information on a 24-hour basis from the main license database at the Commission office in Oklahoma City and from the RCI database. It is also possible to link a specific license with other areas of activity in which a person may be involved, such as lease agreements, multiple ownerships, or dual licenses. The Oklahoma Horse Racing Act and the organizational plan adopted by the Commission provides for a Law Enforcement Division which is responsible for conducting investigations relating to the proper conduct of horse racing and the pari-mutuel system of wagering, including but not limited to barring undesirables from horse racing, undercover investigations, fingerprinting persons licensed by the Commission, and reviewing license applications. Agent then makes additional reports as required and processes evidence. OHRC Law Enforcement Agent receives information on an incident, takes notes & makes report on proper form, Files report with OHRC LED Director. Agent compiles reports and evidence and consults with the OHRC LED Director in regards to requesting a hearing for rule violations. Agent notifies outside Law Enforcement When either Agents or Track Agency, if applicable Security are witness to a violation or have evidence of a violation requiring emergency action, they advise the Board of Stewards immediately and request summary suspension. Records Records Safe Keeping/ Processing If approved by OHRC LED Director, Agent fills out Stewards’ Hearing Request, Witness Information sheet and files them, along with original reports and case file, with the Board of Stewards. If there is a possible violation of Statutes, Agent presents the case to the proper District Attorney for filing. If a criminal case is filed, the Agent follows up by testifying and presenting evidence at trial. Rule violations that occur during race meetings require Boards of Stewards to conduct hearings, to make Findings of Fact, Conclusions of Law, and to issue Stewards' Orders. During 2010, Boards of Stewards issued 389 Orders. Of those Orders, one was appealed or referred to the Commission for Commission determination. Appeals to the Commission, when they occur, are costly in terms of time and expense to the Office of the Attorney General, as well as to the Commission and the respondents, but nonetheless provide protection of individual due process rights. Upon dissolution of the OCPDL equine drug testing program, Truesdail Laboratories, located in Tustin, California, being the successful state primary laboratory contract bidder, began performing these drug tests effective July 1, 2001. Beginning July 1, 2005, Industrial Laboratories of Wheat Ridge, Colorado, became the OHRC primary lab. Texas A & M, University of Pennsylvania, Louisiana State University and the Michigan Department of Agriculture perform split sample drug testing. CY 2010 Commission-sanctioned racing activity resulted in the following 51 positive drug reports, including 12 Furosemide overages and 10 Phenylbutazone overages. Pursuant to provisions of the Oklahoma Horse Racing Act, the Oklahoma-Bred Program is administered by the Commission and is the State of Oklahoma's financial incentive to the breeding and racing of accredited Oklahoma-Bred horses. The Commission authorizes the types and minimum number of accredited Oklahoma-Bred races, as well as the amounts of added purse money and stallion and broodmare awards paid to recipients. The Program is funded through revenue generated by all breakage and unclaimed ticket proceeds from wagering handle, and from a direct percentage of wagering handle, funds generated pursuant to Legislation enacted in 1991 (SB 198) and continued in 1995 through the provisions of SB 111. Senate Bill 198 and Senate Bill 111 reduced the State's tax percentage of takeout from wagering handle and increased the percentage to horsemen's purses and to the Oklahoma-Bred Program. The seventeenth full year in which additional purse funds were generated in accordance with this legislation was in 2010. All Oklahoma-Bred Program proceeds are remitted directly to the Commission for deposit with the Office of the State Treasurer to the credit of the Oklahoma Breeding Development Fund Special Account. Since the first Oklahoma-Bred race was run on August 30, 1984 and through CY 2010, the Commission has paid added purse money, and stallion and broodmare awards amounting to approximately $57.7 million to eligible owners of accredited Oklahoma-Bred racing stock, broodmares, and stallions. The Commission assumed the duties and functions of the official Registering Agency by electing to bring the Oklahoma-Bred registration process in-house and off state bid contract effective January 1, 1992. The Registering Agency registers accredited Oklahoma-Bred racing stock, stallions, and broodmares for eligibility to receive purse supplements and stallion and broodmare awards as authorized by the Commission from the proceeds of the Oklahoma Breeding Development Fund Special Account. Registration fees for horses in the Oklahoma-Bred Program, which are among the lowest in the nation, are set by Commission rule and were deposited by the Commission into the State General Fund through June 30, 1999. SB 1365 amended 3A O.S. § 208.3 to provide that the registration fees be deposited into the Oklahoma Breeding Development Fund Special Account, effective July 1, 1999. 33 - The Commission’s Oklahoma-Bred registration department, the official Registering Agency, receives registration applications, reviews each application for completeness and eligibility, and subsequently registers qualifying horses into the Program. The Registering Agency also keeps abreast of current breed registries' requirements (Quarter horse, Thoroughbred, Paint, Appaloosa, Arabian, and Pinto). During CY 2010, 3,219 horses were registered into the Oklahoma-Bred Program and during FY-2010 $207,288 (compared to $251,200 in FY-2009) in Oklahoma-Bred registration and ownership transfer fees were collected by the Commission and deposited to the Oklahoma Breeding Development Fund Special Account. Of the horses registered into the Oklahoma-Bred Program during 2010, 2,100 were Racing Stock, 1,044 were Broodmares and 75 were Stallions. All payments from the Oklahoma Breeding Development Fund Special Account to breeders and owners are made by the Commission, as has been the case since 1984. Upon receipt of race day reports from the Commission, the Registering Agency verifies the accredited Oklahoma-Bred eligibility of win, place, and show racing stock and of broodmares and sires of those horses. Upon final Commission verification, claims for the authorized amount of purse supplements, stallion and broodmare awards are prepared by Commission staff; and state vouchers (checks) are distributed by the Commission directly to eligible recipient owners and breeders. During 2010, the Commission processed 8,370 checks to eligible recipient owners and breeders. Oklahoma-Bred Registry receives copy of official race program from Claims Department; verifies eligibility of horses for Oklahoma-Bred monies. Registry prepares and proofs Oklahoma-Bred award chart. Completed chart is forwarded to claims Department for processing of payment. File for each horse eligible for Oklahoma-Bred awards for appropriate race is pulled; Oklahoma- Bred awards charts are prepared, indicating racetrack, race date, race type, race number, track purse and Oklahoma-Bred purse supplement. Approved race for which Oklahoma- Bred added purse supplement, Broodmare and/or Stallion awards have been authorized. Stewards declare race is official. Statistical information on each approved race for which Oklahoma-Bred monies have been authorized is entered in to appropriate spreadsheets. The Office of the State Auditor and Inspector inspects pari-mutuel wagering machines and audits the distribution of pari-mutuel wagering handle procedures at Commission-licensed racetracks and Off-Track Wagering Facilities on behalf of the Horse Racing Commission and furnishes reports to the Commission. The Tax Commission collects pari-mutuel taxes and sales taxes due the State directly from the racetracks and provides official reports (excepting sales tax information) to the Horse Racing Commission. |
