INTERIM STUDY REPORT Insurance Committee Rep. Charles Key, Chairman Oklahoma House of Representatives Interim Study 12-002, Rep. Dan Kirby October 16, 2012 Insurance in Indian Country Representative Dan Kirby • Concerns about insurance in Indian country and tribes managing their own risks. • Oklahoma Insurance Department is willing to help navigate through some of these issues. John Doak, Commissioner Oklahoma Insurance Department • The Insurance Department wants to be business friendly. • For tribes, there is an opportunity to invest and create economic job opportunities and learn about how insurance regulation works. • The Insurance Department looks forward to continuing this dialogue. • Insurance industry is a natural progression for the tribes that have growing enterprises. • Opportunity for Oklahoma to be Indian Country friendly. Susan Dobbins, General Counsel Oklahoma Insurance Department • Provided an overview of the financial accreditation process. • Oklahoma has domestic insurers (90 charted in Oklahoma) and foreign insurers (1800 chartered in another state and must apply for a certificate of authority in OK). • The accreditation program sets financial standards for states to meet. Once a state is accredited, a sister state would accept that accredited state’s license. This promotes interstate cooperation and saves money in duplicate examination costs. • A tribal insurance carrier would be subject to these accreditation standards. • Rick Farmer, with the Insurance Department, stated that there is a lot of interest with the tribes. An insurance entity has even indicated that it was contacted by a tribe with interest to purchase the insurance entity in Oklahoma. • The Insurance Department has a very small role in regulating self-funded plans. However, if an insurance carrier purchases stock loss coverage, then that is an activity the department would regulate. Robert Weaver, Tribal Member • Mr. Weaver owns an insurance brokerage with a 3rd party administrator. • Sovereign immunity issue is a big issue when looking at this topic. Tribes each have their own sovereign governments.
