The subject property is situated in the north half of the Northeast Quarter of the Northeast Quarter of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis and San Francisco Railway right-of-way. The purpose of the TBA was to identify potential environmental concerns by reviewing historical data, regulatory information, and by performing a visual inspection of the subject property and surrounding area. The following is an executive summary of the environmental site assessment results: · Results from the lead and asbestos surveys found that the subject property is contaminated with lead dust, lead-based paint, and asbestos. The Oklahoma Department of Environmental Quality Site Cleanup Assistance Program (SCAP) plans to remediate the lead and asbestos contamination on the subject property and properly dispose of all associated waste. The lead dust, lead-based paint, and asbestos contamination in the building constitute recognized environmental conditions (RECs). · DEQ collected a sample of a fallen ceiling tile on April 23, 2013 and analyzed it for asbestos. The fallen ceiling tile did not contain asbestos. See Appendix O for lab results. · DEQ’s contractor, GMR & Associates, performed an asbestos survey on the subject property in February 2012. Non-friable asbestos was found in the mastic and floor tile in Room 14 and 16. The asbestos containing materials are a REC. · There was one underground storage tank (UST) on the subject property. It had a 1,000 gallon capacity and was used to store gasoline. The tank was closed in 1981 and was removed in 1995. During the site visit on April 23, 2013, there was no sign of the UST or soil staining, and the pump island had been removed as well. The UST is considered a historical recognized environmental condition (HREC). · Seven historic dry cleaners were found within one mile of the subject property. One currently operating dry cleaner was found within a one mile radius of the subject property. It is unknown whether the dry cleaners are upgradient of the subject property, but it is possible based on the surface topography. The dry cleaners are considered a potential environmental concern (PEC) according to ASTM E 1528-06. · A former waste water lagoon was on the subject property directly to the east of the armory building. The lagoon had received various Notices of Violation from the Oklahoma Department of Environmental Quality. There was also a 1500 gallon septic tank on the subject property, and a 750 gallon septic tank that was Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 6 abandoned in place in 1988 and not removed. A Memorandum dated January 9, 2001 states that the abandoned tank most likely contains liquid/sludge. The former waste water lagoon is considered a historical recognized environmental condition (HREC). · The former Sapulpa Armory was built in 1949. The land for the building was deeded by the Sapulpa Chamber of Commerce to the State of Oklahoma, on May 10, 1949 to the State of Oklahoma acting as a trustee for the Oklahoma National Guard. The subject property was managed and maintained by the Oklahoma Military Department (on behalf of the State of Oklahoma) until December 21, 2011 when the subject property was transferred to the City of Sapulpa. The subject property is currently owned by the City of Sapulpa, and the city is working to redevelop the subject property for use as an animal shelter. A Memorandum of Agreement (MOA) has been signed between the City of Okemah and the Oklahoma Department of Environmental Quality on September 6, 2011 (Appendix H). Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Creek County Courthouse. · There is one large building on the subject property. Office space in the south part of the armory building, and a drill floor and motor pool room are in the northern part of the structure. No official indoor firing range (IFR) is present on the subject property; however, interviews with site representatives revealed that the drill floor was sometimes used as a make-shift IFR. All equipment has been removed with the exception of a few heating and cooling units and a water heater. · Adjoining properties consist of the following: a gravel and sand storage area to the north, and residential area to the north of that; the Creek County District #1 county barn to the northeast; a railroad and Route 66 to the southeast and south; commercial area to the south past Route 66; the Sapulpa Golf Course to the southwest; and residential area to the immediate west, and further west is Rock Creek. The subject property is situated along the railroad tracks, and further to the northeast there has been heavy industrial development, including an oil distributer, a glass manufacturing plant, and a brick plant. · The subject property is located on the western side of the City of Sapulpa. Sanborn Fire Insurance maps do not show a detailed view of the subject property until 1961, at which point the armory building is present. Adjacent properties contained industrial and commercial buildings including the Hastings Gasoline Company, Sapulpa Brick Plant, and the Miller Combination Bailer & Pump Company. Historical aerial photographs show the various stages of the industry surrounding the subject property. The aerial image from 1941 shows mainly vacant land immediately surrounding the subject property, although industrial development is visible to the northeast of the subject property, and residential development is seen to further to the north and west. Aerial images from 1961 Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 7 onward show dense industrial and commercial development to the north, east and south of the subject property. A search through county records shows that the first deed transaction on the southern portion of the subject property was in 1904 when the portion was allotted from the Muskogee (Creek) Tribe of Indians, in Indian Territory to heirs of Polly Spocogee. The first deed transaction on the northern portion of the subject property was found in 1942 when the Miller Sand Pump company sold the portion to Russell Beaty. It is unclear what development, if any, the Miller Sand Pump company had on the subject property, but one small building was visible in Track Lot C in the Sanborn map of 1921. · No National Priority List (NPL) sites, deleted NPL sites, archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) sites, Resource Conservation and Recovery Act (RCRA) subject to corrective action (CORRACTS) sites, RCRA non-corrective actions (non- CORRACTS) treatment, storage, and disposal (TSD) listings, Emergency Response Notification System (ERNS) listings, Institutional Controls/Engineering Controls, RCRA generators, Voluntary Cleanup (VCP) sites, Brownfield sites, or State landfills and/or solid waste disposal sites were found on the subject property or within ASTM recommended search radii. The subject property is on the DEQ SCAP list for cleanup of lead and asbestos contamination. · A search for leaking underground storage tanks (LUSTs) with the ASTM search radius shows 61 LUSTs within 0.5 miles of the subject property. It is unknown whether the LUSTs are upgradient of the subject property, but it is possible based on the surface topography. · There was no record of oil and gas production on the subject property or adjoining properties in the OCC oil and gas records. · Several pole-mounted transformers were noted to west and south of the armory building. It is unknown if they contain polychlorinated biphenyls (PCBs). Fluorescent lighting ballasts are located throughout the offices, storage rooms, kitchen, and restrooms in the main armory building as well as throughout the motor pool building. The lighting ballasts all appeared to be in good condition. All fluorescent bulbs contain mercury and should be handled as Universal Waste unless documentation and/or sampling demonstrate they are not hazardous. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 8 2.0 INTRODUCTION The State of Oklahoma Department of Environmental Quality (DEQ) under a Brownfield Assistance Agreement (No. RP96681001-0) (Ref. 1) with the U.S. Environmental Protection Agency (EPA) conducted a Targeted Brownfield Assessment of a property located at 13 Sahoma Lake Road, Sapulpa, Creek County, Oklahoma. 2.1 Purpose The purpose of this assessment is to look at the environmental conditions within the target area and provide this information to the City of Sapulpa as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund) (Ref. 2), as provided in the Small Business Relief and Brownfield’s Revitalization Act of 2002 (Public Law 107-118, Subtitle B) (Ref. 3). The purpose of a Phase I Environmental Site Assessment is to identify, to the extent feasible, recognized environmental conditions in connection with the subject property through a systematic review of readily available information sources and a site reconnaissance. DEQ is providing technical assistance to the project by evaluating the environmental condition of the subject property prior to the City of Sapulpa converting the Former Sapulpa National Guard Armory Building for use as an animal shelter. Funding for this assessment has been provided by the EPA. 2.2 Detailed Scope-of-Services DEQ examined the current use of the subject property and identified the historical uses of the subject property to determine if recognized environmental conditions exist. DEQ examined historical documents, governmental databases, oil and gas records, aerial photographs, Sanborn Fire Insurance Maps, and conducted interviews and a site reconnaissance of the area. A good faith effort was made to identify possible environmental conditions that might affect the development of the subject property. 2.3 Significant Assumptions History and knowledge of the subject property shows that the building was used as a National Guard Armory. The National Guard Amory was built in 1949, and the subject property was mostly vacant land with one small building until 1949 when the Sapulpa Chamber of Commerce deeded the subject property to the State of Oklahoma for use as a National Guard Armory. There has been no oil and gas exploration on the subject property according to Oklahoma Corporation Commission records. Since the building was constructed in the 1948, the building may contain ACM. The U.S. began banning the use of asbestos in most building materials in the 1970s due to Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 9 studies confirming the harmful health effects caused by exposure to airborne asbestos. Insulation, floor tile, and mastic observed in the building during site reconnaissance conducted on April 23, 2013, have been confirmed to contain asbestos. DEQ’s contractors performed a lead and asbestos survey on the subject property. Lead-based paint, lead dust, and asbestos containing materials were found in the building. Details are included in Section 5.2 General Site Assessment and in Appendix O. 2.4 Limitations and Exceptions The purpose of an environmental site assessment is to identify actual or potential “recognized environmental conditions” that may result in liability, land use restrictions, or cause delays in revitalization. The ASTM Phase I Environmental Site Assessment E 1527 – 05 (Ref. 4) is the minimum standard for environmental due diligence in the real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfields Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the revitalization project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. This assessment was conducted under constraints of time, cost, and scope and reflects a limited investigation and evaluation. It reflects the normal degree of care and skill that is ordinarily exercised by environmental professionals conducting business in this or similar localities. In no event shall the DEQ or its employees be liable for any damages, injury, loss, cost, or expense whatsoever arising in connection with the use or reliance on the information contained in this report, except as otherwise provided by law. The information in this report is based on a review of governmental records, interviews with knowledgeable representatives of the property, information provided by the City of Sapulpa, and observations of the environmental professional. The result of this assessment, as written in this report, is valid as of the date of report. The assessment does not include sampling of rock, groundwater, surface water, or air. For qualifications of environmental professionals see Appendix A. 2.5 Special Terms and Conditions This assessment report has been prepared for the City of Sapulpa by the DEQ using EPA funding. Information about this report will be provided to the EPA for its files. This report and the working file are public record and subject to the Oklahoma Open Records Act and the federal Freedom of Information Act. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 10 3.0 SITE CHARACTERIZATION AND HISTORY 3.1 Location and Legal Description The subject property is to the east of Sahoma Lake Road, to the northwest of Highway 66, and to the south of W. Thompson Avenue, at 13 Sahoma Lake Road, Sapulpa, Oklahoma, 74066 in Creek County. The subject property is located at latitude 35.996157 and longitude -96.129820. The subject property consists of approximately 1.8 acres of land and contains the former National Guard Armory. A site map and topographical map depicting the subject property have been provided in Appendix F. The subject property is located in the SE ¼ of the SE ¼ of the NW ¼ and the NE ¼ of the NE ¼ and the SW ¼ of Section 34, Township 18 North, and Range 11 East of the Indian Meridian, lying North and West of the St. Louis and San Francisco Railway right-of- way in Creek County, Oklahoma. The subject property’s legal location is described as follows: The West 275 feet of Trackage Lot “C” in Westport Addition to the City of Sapulpa, Creek County, Oklahoma, less a tract thereof described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the point of beginning; and All that part of the N ½ of the NE ¼ of the NE ¼ of the SW ¼ of the Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way. Creek County Courthouse Records showed the following history on the subject property (See Appendix G). · On March 26, 1904, the southern portion of the subject property described as “N½ of NE ¼ of NE ¼ of SW ¼ (less .92 Acres for St. Louis & San Francisco R.R. Right of Way) of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way” was allotted from the Muskogee (Creek) Tribe of Indians, in Indian Territory to heirs of Polly Spocogee. · On February 7, 1925, Timmie Fife and Sarah Fife, sold the southern portion of the subject property described as “All that part of the NE ¼ of the NE ¼ of the SW ¼ Section Thirty (34) Four, Township Eighteen (18), Range Eleven (11), lying North and West of the St. L and S F Right of way” to the Miller Combination Bailer & Pump Company. · On December 15, 1942, Miller Sand Pump company sold the subject property described as “Block “C” in the Westport Addition to Sapulpa, Creek County, Oklahoma, according to the recorded plat thereof, and That part of the NE ¼ of the NE ¼ of the SW ¼ of the Section 34, Township 18 North, Range 11 East, Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 11 lying North and West of the St. Louis & San Francisco Railway right-of-way” to Russell Beaty. · On July 6, 1944, Russel Beaty and Oneida Beaty sold the subject property described as “Trackage Lot “C” Westport addition to the City of Sapulpa, except a tract beginning at the Northwest corner of said Lot “C”, thence North 150 feet to the point of beginning, also except right-of-way of St. L. S. F. Railroad Company, and that part of the NE ¼ of the NE ¼ of the SW ¼ of Section 34-18-11 East I.M. lying North of the St. Louis San Francisco Railway Company’s right-of-way” to J.M. Bocox and Mattie B. Bocox. · On December 6, 1948, the Miller Sand Pump company, successor to The Miller combination Bailer and Pump company, sold a portion of the subject property described as “all that part of the North Half of the Northeast Quarter of the Northeast Quarter of the Southwest Quarter of Section 34, Township 18 North, Range 11 East, lying and situated North and West of the St. Louis & San Francisco Railroad right-of-way” to J.M. Bocox and Mattie B. Bocox. · On February 3, 1949, J.M. Bocox and Mattie B. Bocox, granted the subject property described as “all that part of the N ½ of NE ¼ of NE ¼ of SW ¼ of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way, and Trackage Lot “C” in Westport Addition to the City of Sapulpa, less a tract therein, particularly described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the place of beginning” to the Sapulpa Chamber of Commerce. · On May 10, 1949, the Sapulpa Chamber of Commerce granted the subject property described as “the West 275 feet of Trackage Lot “C” in Westport Addition to the City of Sapulpa, Creek County, Oklahoma, less a tract thereof described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the point of beginning; and, all that part of the N ½ of NE ¼ of NE ¼ of SW ¼ of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way” to the State of Oklahoma, acting as trustee for the Oklahoma National Guard. · On December 21, 2011, the State of Oklahoma, acting by and through the Oklahoma Military Department granted the subject property described as “the West 275 feet of Trackage Lot “C” in Westport Addition to the City of Sapulpa, Creek County, Oklahoma, less a tract thereof described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the point of beginning; and, all that part of the N ½ of NE ¼ of NE ¼ of SW ¼ of Sec tion 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way” to the City of Sapulpa, Oklahoma. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 12 3.2 Site and Vicinity Characterization The former Sapulpa Armory was built in 1949. According to Creek County land records, the land for the building was owned by Sapulpa Chamber of Commerce and deeded to the State of Oklahoma, acting as a trustee for the Oklahoma National Guard on May 10, 1949 (see Appendix G). The subject property is a tract of land about 1.8 acres in size, and is located at 13 Sahoma Lake Rd., Sapulpa, Oklahoma 74066. The area where the subject property and adjacent properties are located is best characterized as a mixture of residential, commercial, and industrial space. To the west there is residential property and further west is Rock Creek. To the north is a sand and gravel storage area and further to the north is more residential area. To the northeast is the county barn for Creek County District #1. To the east, southeast, and south of the subject property is a railroad and the Route 66. Past the highway to the south is a commercial area and to the southwest is the Sapulpa Golf Course. A review of the topographical map indicated that the surface elevation of the subject property is approximately 650 feet above mean sea level. The subject property is situated on a slope and the topographical gradient is south southeast, toward the railroad and Route 66. The topographical map can be found in Appendix F. 3.3 Description of Structures, Roads, and Other Improvements The subject property consists of the former armory building. Chipped floor tiles were observed in the entrance to room 13. The drill floor and motor pool room had damaged ceiling tiles and fallen pieces were observed on the floor. Pooling water was also observed in the drill floor. Peeling paint was observed on several window sills. Peeling paint and wall damage was also noticed in the former armory building, in particular in the motor pool room (room 2). Roads surrounding the Armory are paved with asphalt. Photos can be found in Appendix B and a map indicating the room numbers can be found in Appendix B and F. 3.4 Owner, Property Manager, and Occupant Information The subject property is owned by the City of Sapulpa and is currently unoccupied. The DEQ Site Cleanup Assistance Program is in charge of identifying environmental hazards and conducting the lead and asbestos cleanup of the Armory. The Oklahoma Military Department transferred ownership of the armory to the City of Sapulpa prior to completion of remedial activities (Appendix G). 3.5 Information Reported by User Regarding Environmental Lien or Specialized Knowledge or Experience The property owner and/or representatives reported no environmental liens on the subject property and had no specialized knowledge or experience regarding recognized environmental conditions. The DEQ conducted a search for environmental liens at the Creek County Courthouse. No environmental liens or use limitations were reported for the subject property, and it does not appear in the Brownfield IC database. Following Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 13 abatement of lead and asbestos on the subject property, a deed notice will be placed on the subject property by DEQ. 3.6 Commonly Known or Reasonably Ascertainable Information Ted Fischer, Director of Economic Development for the City of Sapulpa, had no exceptional knowledge of commonly known or reasonably ascertainable information about possible environmental conditions on the subject property. It is known within the community that the building functioned as a National Guard Armory. A Memorandum for Record documenting a Site Assistance Visit (SAV) on April 16, 2009 states the following: · Background: the Sapulpa Armory (Sapulpa Readiness Center) was constructed in 1949, is approximately 9,880 square feet in size and is situated on approximately 3.0 acres. · Adequate secondary containment was not present for hazardous materials and POLs (Petroleum, Oils, and Lubricants) stored in the conex. · The facility is zoned commercial general (CG), and is bordered by trees and residential zoned land to the north; to the south is the Burlington Railroad and Highway 66, and agricultural zoned land; further southeast is industrial moderate zoned land; to the west is Sahoma Lake Road and agricultural zoned land; to the ease is Creek County Commissioners commercial general zoned land. Probably wetlands are located approximately 655 feet to the west and approximately 1,400 feet to the west, southwest. 3.7 Valuation Reduction for Environmental Issues Valuation of the subject property is outside the scope of this assessment. A professional appraiser should be consulted to place a value on the subject property. 3.8 Current Use of the Property The buildings are currently empty. The rest of the subject property is vacant land. 3.9 Past Use of the Property 3.9.1 Review of Aerial Photographs Historic aerial photographs were searched to view the changes to the subject property over time. The 1941 aerial photograph was found at the Oklahoma Department of Libraries. The 1969 aerial photograph was found in the records at the Oklahoma Department of Environmental Quality. The aerial photographs from 1995, 2003, 2004, 2005, 2006, 2008, 2010, 2011 and 2012 were found on Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 14 Google Earth. All of these photographs are located in Appendix C. The following represents a summary of what was found at the subject property from each photograph. 1941 aerial photograph The 1941 aerial photograph shows the subject property to be primarily vacant land, with one small building on the southwestern corner, near a road and the railroad. The adjacent property to the north is vacant land and further north development appears to be residential. The adjacent property to the northeast and east also are vacant land. The subject property is bordered to the south and southeast by a railroad running diagonally from the southwest to the northeast. Next to and parallel to the railroad is a larger road. There is a building on the adjacent property to the west, beyond which is Rock Creek. The structures associated with the armory are not present in the photograph. 1969 aerial photograph The 1969 aerial photograph shows the subject property with the armory building present. The small building noted in the 1941 aerial is no longer present. The railroad borders the subject property on the southeast and south and a wide road runs parallel to the railroad. South of the road more industrial or commercial developments have been built. There is a building on the adjacent property to the west, beyond which is Rock Creek. 1995 aerial photograph The 1995 aerial photograph shows the armory building on the subject property. A lagoon is visible on the subject property to the east of the armory building. The adjacent property to the north appears to be used for gravel and sand storage and there are several structures on the adjacent property to the northeast. The building across the street to the west also remains. 2003 aerial photograph The 2003 aerial photograph shows some changes from the 1995 aerial photograph. The lagoon on the subject property appears to be filled in or is no longer present. 2004 aerial photograph The 2004 aerial photograph shows no significant changes from the 2003 aerial photograph. 2005 aerial photograph The 2005 aerial photograph shows no significant changes from the 2004 or the 2003 aerial photograph. 2006 aerial photograph Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 15 The 2006 aerial photograph shows some changes from the 2005 aerial photograph. No significant changes are noticed on the subject property or immediately adjacent properties. On the property further to the northeast that appeared to be an auto salvage yard, the cars are no longer visible. 2008 aerial photograph The 2008 aerial photograph shows no significant changes from the 2006 aerial photograph. 2010 aerial photograph The 2010 aerial photograph shows no significant changes from the 2008 or the 2006 aerial photograph. 2011 aerial photograph The 2011 aerial photograph shows no significant changes from the 2010, 2008 or 2006 aerial photograph. 2012 aerial photograph The 2012 aerial photograph shows no significant changes from the 2011, 2010, 2008 or 2006 aerial photograph. 3.9.2 Fire Insurance Maps · Sanborn Fire Insurance maps were viewed and downloaded from the Oklahoma Department of Libraries website (Ref. 6). Sanborn maps of the city of Sapulpa were found for 1911, 1915, 1920, 1929, and 1929-1961. The subject property is seen as “Track Lot C” in the Sanborn overview maps for 1915, 1920, 1929, and 1929-1969, but is not shown in a close-up map until 1929-1961. Sanborn maps are in Appendix E. · The 1920 Sanborn map does not show a close-up view of Track Lot C, but shows that the Sapulpa Brick Plant operated on Track Lot B to the northeast of the subject property and shows Sunflower Glass Company, Manufacturers of Window Glass, on the property to the southeast of the Sapulpa Brick Plant. · The 1929 Sanborn map does not show a close-up view of Track Lot C, but shows formerly Hastings Gasoline Company on Track Lot B to the northeast of the subject property. Miller Combination Bailer & Pump Company is also on Track Lot B. One small structure is seen on Track Lot C on the other side of N. Wallace Road. United Brick and Tile Company, Sapulpa Plant is located in Track Lot A, further northeast of Track Lot B. Sunflower Glass Company, leased by Victory Window Glass Company is across the street and railroad from Track Lot A. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 16 · The 1929-1961 Sanborn shows the armory on the subject property in Track Lot C. Wickham Packing Company and Feed Stock Pens are present in Track Lot A. And the Sapulpa Brick Company is still across the railroad to the south of Track Lot A. 3.10 Current and Past Uses of Adjoining Properties The aerial images from 1941 and 1969 show the development of the subject property and the adjoining properties. 1941 aerial photograph The adjacent property to the north is vacant land, and further north development appears to be residential. The adjacent property to the northeast and east also are vacant land. Further to the east northeast appears to be a larger industrial complex. The subject property is bordered to the south and southeast by a railroad running diagonally from the southwest to the northeast. Next to and parallel to the railroad is a larger road. South of the road some structures are apparent, but it is unclear of what type. There is a building on the adjacent property to the west, beyond which is Rock Creek. The structures associated with the armory are not present in the photograph. 1969 aerial photograph Development can be seen on the adjacent property to the north, though it cannot be determined what kind of development. Several structures have been built on the adjacent property to the northeast. The industrial area to the northeast remains. The railroad borders the subject property on the southeast and south, and a wide road runs parallel to the railroad. South of the road more industrial or commercial developments have been built. There is a building on the adjacent property to the west, beyond which is Rock Creek. 1995 aerial photograph The adjacent property to the north appears to be used for gravel and sand storage, and there are several structures on the adjacent property to the northeast. Further to the northeast there appears to be an auto salvage yard, and the industrial area to the northeast still remains. Commercial development is still present south of the railroad. The building across the street to the west also remains. 2003-2005 aerial photograph The 2003, 2004, and 2005 show no significant changes in the adjacent properties. 2006 aerial photograph On the property further to the northeast that appeared to be an auto salvage yard, the cars are no longer visible. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 17 2008-2012 aerial photograph The 2008, 2010, 2011, and 2012 aerial photograph shows no significant changes from the 2006 aerial photograph. Interviews with past occupants revealed the following other past uses of adjoining properties: · The property directly to the north is used for gravel and sand storage. To the northeast is the county barn for district #1. There was a spill of a 55-gallon oil drum around 1992. EPA made them dig it out twice. · The property to the east is grassy, vacant land, and then there is the railroad. Directly to the east of the armory building there used to be a lagoon on the subject property. · The property to the south is also grass, then a parking lot, then the railroad, then Route 66, followed by the Sapulpa Golf Course. · To the west is a road, then a few residential properties. During the site visit on April 23, 2013, adjoining properties were observed to contain the following: · To the north of the subject property is an area that appears to be a gravel storage location. The topography slopes upward to the north. · To the east of the subject property is vacant land and then the railroad. · To the south of the subject property is the railroad and then Route 66. The topography slopes downward to the south. · To the west of the subject property appears to be residential buildings. 3.11 Environmental (Physical) Setting The DEQ reviewed several sources to obtain information on the physical setting of the subject property and its surrounding areas. These sources include: The United States Department of Agriculture Oklahoma County Soil Survey, Oklahoma Geological Survey, Oklahoma Water Resource Board data viewer, and the Federal Emergency Management Association. Review of the physical setting of the area is to evaluate the sensitivity of the hydrogeology to potential contamination from sources either on or near the subject property. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 18 3.11.1 Surface Water Characteristics The topography of the area is very sloped. The former Sapulpa Armory is located at a surface elevation of approximately 650 feet above mean sea level and the area slopes from the north down to the south. The topographical gradient is to the south-southeast towards the railroad and Route 66. Rock Creek is located approximately 0.13 miles west of the subject property. There is no public water supply intake point within a 1 mile radius of the subject property. The public water supply intake for the City of Sapulpa is Lake Sahoma, approximately 2.6 miles north of the subject property, and Skiatook Lake, approximately 21 miles to the north of the subject property. No surface water bodies are on the subject property. There used to be a waste water lagoon on the subject property. Records of a Survey of Lagoon/Septic Systems conducted by the Oklahoma Military Department in 2000 show that the lagoon had overflow problems. Additional comments are noted below and the complete document can be found in Appendix P. · There were septic tanks on the subject property. As of 2000, there was an existing 1500 gallon oval tank. There was also a nearby rectangular tank of approximately 750 gallons that was abandoned in place in 1988 and not removed. It was presumed that the 750 gallon tank most likely contained liquid/sludge. · The lagoon was reported to fail to meet the needs of the Armory for several years and reflux of waste into the armory is not unusual. The lagoon system was determined to likely be of insufficient size and volume to accept required waste loading. · The Sapulpa Armory received Notice of Violation citations from the Oklahoma Department of Environmental Quality for periodic impoundment overflow and vegetative growth. According to the Federal Emergency Management Association (FEMA), the subject property is in Zone X flood plain and in an area adjacent to, but outside of, the Zone AE flood plain. According to FEMA (Ref. 15), Zone AE is the area subject to inundation by the 1-percent-annual-chance flood event determined by detailed methods. Zone X is the area of minimal flood hazard, which is higher than the elevation of the 0.2-percent-annual-chance flood. A map of this information is located in Appendix D. The subject property obtains its drinking water from the City of Sapulpa, which uses Sahoma Lake and Lake Skiatook for its water source. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 19 3.11.2 Subsurface Geological Characterization According to the Soil Survey of Creek County, Oklahoma, the subject property soils are composed approximately 55% of Dennis and Okemah Soils with 3% to 5% slope and 45% of Collinsville and Talihina soils with 12% to 20% slope. Collinsville and Talihina soils exhibit 12 to 20 percent slopes, are found on hillslopes and the backslope, and are somewhat excessively drained to moderately well drained. The depth to water table is about more than 80 inches and bedrock is 8 to 20 inches deep for the Collinsville soils and 6 to 21 inches and 6 to 20 inches respectively for the Talihina soils. Dennis and Okemah soils exhibit 3 to 5 percent slopes, are found on hillslopes and paleoterraces, and are somewhat poorly drained. The depth to water table is about 12 to 30 inches. Dennis and Okemah soils both have a high available water capacity (about 10.7 inches). 3.11.3 Ground Water Characteristics The hydrogeology as reported by the Oklahoma Water Resources Board (OWRB) indicates that there is no major or minor aquifer in this area. The OWRB Reported Well Log Viewer was utilized to make a map of groundwater and monitoring wells within a 0.5 and a 1 mile radius of the subject property. The closest groundwater well to the subject property is located 0.5 miles southeast and is used for domestic purposes. There are 23 monitoring wells within 0.5 miles of the subject property, all used for site assessment. The majority of the monitoring wells are from Clark Oil Distributors, 0.35 miles to the northeast of the subject property. There was one Other Well, used for soil evaluation 0.1 mile east of the subject property. For a list and map of wells that are within 1 mile of the subject property, see Appendix M. 3.11.4 Air Characteristics No air emissions were noticed at the subject property or the adjoining properties. The DEQ dataviewer database was searched for Air Quality Permitted Facilities (AQPF) and 2010 Point Source Emissions. No AQPF was found. One 2010 Point Source Emissions was found within 1 mile radius from the subject property. · Renwood Cleaners located at 120 S Park, Sapulpa, Oklahoma 74066 is 0.98 miles to the east of the subject property. SIC Code: 7216; Company ID: 1964; and Facility ID:4096. Emissions: 2.285 tons of VOC. Report Generated on 12/14/2011. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 20 No odors were noticed outside of the subject property during the site visit. However, there is a potential for lead dust and asbestos emissions from the subject property. 4.0 RECORDS REVIEW A regulatory database search was conducted by the DEQ. This search included, at a minimum, those records and distances from the subject property dictated as appropriate in the ASTM standard. The DEQ performed a review of available federal and state databases to assess whether the subject property or proximate properties were listed as having environmental concerns, which could have an adverse impact on the subject property. The following provides a summary of the databases reviewed. 4.1 Federal National Priorities List (NPL) The EPA database was searched for NPL sites near the subject property within the ASTM’s recommended search radius of one mile (Ref. 8). The subject property is not a listed NPL site. There are no NPL sites reported within a one-mile radius of the subject property. There is also an EPA database for Deleted NPL sites, which ASTM requires to be reported within ½ mile of the subject property (Ref. 9). No deleted NPL sites are within the ½ mile search radius. A list of all sites in Oklahoma on the NPL, Deleted NPL, Proposed NPL, Partially NPL, and Construction Completion NPL sites is included in Appendix N. 4.2 Federal CERCLIS List The EPA database for Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) Information Systems (CERCLIS) was searched for active and archived CERCLIS sites on and near the subject property (Ref. 10). The ASTM’s recommended search radius of the subject property for both active and archived CERCLIS sites is ½ mile. No active CERCLIS sites were found within ½ mile of the subject property. The subject property is not listed on the archived CERCLIS list. The search result is included in Appendix N. 4.3 Federal RCRA CORRACTs List The EPA database for RCRA facilities subject to corrective action was searched within the ASTM’s required minimum distance of one mile of the subject property (Ref. 11). No RCRA CORRACT facility was found within the one-mile radius of the subject property. The search result is included in Appendix J. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 21 4.4 Federal RCRA non-CORRACTS TSD List The EPA database for RCRA facilities not subject to corrective action was searched within the ASTM’s required minimum distance of ½ mile of the subject property (Ref. 11). No RCRA non-CORRACT Treatment, Storage, and Disposal (TSD) sites are within the ½ mile radius of the subject property. The search result is included in Appendix J. 4.5 Federal RCRA Generators List The EPA RCRA Notifiers and DEQ RCRA Notifiers databases were searched for RCRA generators within the ASTM’s required minimum search distance of the subject property (Ref. 11,16). The minimum distance is the property and adjoining properties. The subject property did not have any RCRA notifiers or generators. No large quantity generators or small quantity generators were reported within the subject property and its adjoining properties. However, several small quantity generators, large quantity generators, and conditionally exempt generators were found in the City of Sapulpa. The search result is included in Appendix J. ASTM requires a minimum search distance of the subject property only when identifying ERNS cases. No ERNS sites were reported within the property or the adjoining properties. The ERNS data for all results near the City of Sapulpa is included in Appendix I. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 22 4.7 Federal Institutional Control/Engineering Control Registries Federal Institutional Control/Engineering Control registries are under development, but not available at this time. There are no known Institutional Controls/Engineering Controls on the subject property according to the representatives of the subject property and a search of county land records. 4.8 State-Equivalent NPL DEQ does not have a State-equivalent NPL database. Oklahoma does not have a State Superfund law to establish a State-equivalent NPL database. 4.9 State-Equivalent CERCLIS DEQ does not have a State-equivalent CERCLIS database. 4.10 State Landfill and / or Solid Waste Disposal Sites DEQ regulates landfills and solid waste disposal sites across the State of Oklahoma (Ref. 13). State landfills and solid waste disposal facilities were searched in the DEQ database within the ASTM required minimum distance of ½ mile from the subject property. No permitted landfills or solid waste disposal facilities are located within the search distance of the subject property. 4.11 State Leaking UST List The Oklahoma Corporation Commission UST Notification Database and the OWRB data viewer were searched to locate any known LUSTs sites located within the ASTM’s minimum search distance of a ½ mile of the subject property. OWRB found 61 LUST sites within the ½ mile radius, 49 of which belonged to Clark Oil Distributors. OWRB information and map of all LUST sites found within ½ mile are included in Appendix M. Information from OCC on LUST cases, including detailed records, are included in Appendix L. · Clark Oil Distributors, Inc. is located at 801 W. Dewey, Sapulpa, Creek County, Oklahoma 74066 (35.998188,-96.124593). The facility number is 1902111, Case Number 064-3043. There are 55 tanks reported for this site ranging from 1000 to 12,000 gallon in size and including 44 above ground storage tanks (ASTs) and 11 underground storage tanks (USTs). Of the ASTs, 42 are currently in use, one is temporarily out of use and one is permanently out of use; of the USTs two are currently in use and 9 are currently out of use. The tanks are for retail and distributing and hold a variety of materials including gasoline, diesel, kerosene, hydraulic fluid, motor oil, and methanol. All tanks installed before 2000 are permanently out of use. The Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 23 tanks in use were installed between 2000 and 2010. The site is currently active. The most recent document showing case closure is included in Appendix L. · Former Pretty Quick #2 is located at 1000 W Dewey, Creek County, Sapulpa, Oklahoma (35.996227, -96.127061). The facility number is 1910625 and the case number is 064-RW. Another case 064-3257 was found to be related to this case, and a letter detailing the request to deactivate case 064-3257 and reopen the closed case 064-RW, because they are related to the original 064- RW case. There are 5 tanks reported for this site and all are permanently out of use. Three tanks were installed in 1974 and held up to 2,000, 3,000, and 10,000 gallons of gasoline. One 4000 gallon tank was installed in 1991 for gasoline and another 4,000 gallon tank was installed in 1998 for diesel. The tanks were closed in 2007 and 2008. Documents and information about the LUST case can be found in Appendix L. · Johnson’s Mini Mart is located at 701 W. Dewey Sapulpa, Creek County, Oklahoma (35.998114, -96.121501). The facility number is 1913107, and the case number is 064-1946. The case is closed. The site is inactive. There are three tanks reported for this site and all are permanently out of use. A 6,000 gallon tank that held diesel was installed in 1989 and closed in 1997. The 10,000 gallon tank that held gasoline was installed in 1980 and closed in 1997. Documents and information about the LUST case can be found in Appendix L. · US #1 is located at 420 W. Dewey, Sapulpa , Creek County, Oklahoma (35.998232, -96.11963). The facility number is 1912612 and the case number is 064-3293. The case is open. The site is inactive. There are three tanks reported for this site, all held gasoline, and all are permanently out of use. One tank is of an unknown size and was closed in 1980. The other two tanks, one 4,000 gallons and one 8,000 gallons, were installed in 1983 and were closed in 1999 and 2011 respectively. Documents and information about the LUST case can be found in Appendix L. · City of Sapulpa Central is located at 410 S. Hawthorn, Sapulpa, Creek County, Oklahoma (35.993563, -96.127798). The facility number is 1906041. The LUST case was closed in 11/9/1994 and the facility was closed in 2000. There were two tanks reported for this site and both are permanently out of use. The 8,000 gallon gasoline tank and the 8,000 gallon diesel tank were both installed in 1980 and closed in 1996. Documents and information about the LUST case can be found in Appendix L. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 24 4.12 State Registered UST Sites The Oklahoma Corporation Commission UST Notification Database was searched to locate registered USTs located within the ASTM’s minimum search distance of the subject property and its adjoining properties. There were was one former registered UST on the subject property. A record from the Oklahoma Military Department dated October 24, 1990 states that the fuel tank had been out of service since March 1981, and that no fuel had been purchased or pumped from the tank since that time. A Closure Report states that the tank was removed on May 25, 1995. The 1000 gallon steel tank was installed in 1956, but was out of use since 1981. An additional letter from March 12, 1998, shows that Caldwell Environmental Associates went on site to excavate near a vent pipe on the subject property, but that they could not find the UST. It was determined that the UST had been previously removed. (Appendix L). In addition, 12 UST facility sites were found on the OCC database within 0.5 miles of the subject property. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 25 · Beath’s Texaco – there are 3 tanks reported for this site, all permanently out of use. All three tanks were installed in 1978 and were temporarily out of use as of 1999. The tanks included one 500 gallon diesel tank, one 1,500 gallon gasoline tank, and one 2,000 gallon gasoline tank. · Wayne Ramery - no tanks are reported for this facility. · J Bruton Dx – no tanks are reported for this facility. · Harvey Deason Texaco – no tanks are reported for this facility. The facility was closed in 1980. · Creek County Hwy Dept Dist #1 – there are four tanks reported for this facility. Two tanks were installed in 1960. One 1,000 gallon tank with unknown contents and one 1,000 gallon gasoline tank. Both were closed in 1991 and are permanently out of use. Two other tanks were installed in 1976, one 10,000 gallon diesel tank and one 10,000 gallon gasoline tank. Both are temporarily out of use. 4.13 State Institutional Control/Engineering Control Registries The DEQ Institutional Control/Engineering Control Registry for Brownfields, Voluntary Cleanup program, Site Cleanup Assistance Program, and Superfund (Ref.18) was searched. There are no known Institutional Control/Engineering Controls in effect for this subject property. 4.14 State Voluntary Cleanup Sites The DEQ Voluntary Cleanup Program (VCP) database was searched for VCP sites within the required ASTM search distance of ½ mile of the subject property (Ref. 14). No VCP sites are located on or within ½ mile of the subject property. 4.15 State Brownfield Sites The DEQ Brownfield database was searched for Brownfield sites within the required ASTM search distance of ½ mile of the subject property (Ref. 14). No Brownfield sites were found on or within ½ mile of the subject property. 4.16 Oil and Gas Records The subject property is located in the SE ¼ of the SE ¼ of the NW ¼ and the NE ¼ of the NE ¼ and the SW ¼ of Section 34, Township 18 North, and Range 11 East of the Indian Meridian, lying North and West of the St. Louis and San Francisco Railway right- Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 26 of-way in Creek County, Oklahoma. DEQ performed a search of oil and gas records from the Oklahoma Corporation Commission’s (OCC) oil and gas records database. The subject property is in an area where there is a history of oil and gas development. Oil and gas records were searched to record the known history of well development on and near the subject property. A search area consisted of the subject property as described from the legal location above and the quarter, quarter, quarter sections directly above and up gradient of the subject property. No well records were found in adjacent areas. Search results for wells near the area are located in Appendix L. 4.17 State Environmental Complaints and Local Services Response The DEQ State Environmental Complaints and Local Services database was searched for the subject property. No complaints have been reported for the subject property (Appendix N). 4.18 Dry Cleaner Databases The DEQ databases for dry cleaners (Ref. 19) and yellowpages.com (Ref.20) was searched for dry cleaners in the City of Sapulpa. One active dry cleaner was found with a one mile radius. Seven historic dry cleaners, located at unique addresses, were found within the search radius of 1.0 mile. Rachel Francks and Franziska Landes of the DEQ met the caretaker of the subject property, Ted Fischer, Director of Economic Development for the City of Sapulpa and Larry Prescott, former Recruiter at the Sapulpa Armory and were escorted to the subject property. Larry Prescott has been involved with the armory building extensively and served as the Recruiter at the Sapulpa Armory and served in the Oklahoma Army National Guard before that. He was active at the Sapulpa Armory from approximately 1964 to 1996. Larry Prescott answered questions to the best of his knowledge on the subject property. Mr. Prescott led Francks and Landes inside the building and gave his knowledge about what the building was used for and what kinds of activities occurred there in the past. All areas of the building were observed noting any environmental conditions that might need additional investigation. The entire outside area of the armory was walked around for observations that might need additional investigation as well. 5.2 General Site conditions The former Sapulpa Armory property (subject property) is composed of a brick building of approximately 9,880 square feet that was built in 1948 and does not contain a formal indoor firing range (IFR). The building is currently unoccupied, although some storage boxes from the City of Sapulpa were observed inside the building. The northern part of the building includes the drill floor that was also used as an unofficial indoor firing range. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 28 The southern part of the building includes mainly rooms used for office space and storage space. The property surrounding the building consists of residential area to the west, beyond which is a wooded area and Rock Creek; a gravel and sand storage area from the City of Sapulpa to the north; a City of Sapulpa motor pool and vehicle maintenance area to the northeast, beyond which is an industrial area; a railroad and Route 66 to the east and to the south; to the south of which is more industrial area. The subject property is on the west side of town along the railroad tracks in an area that was and is the industrial area of Sapulpa. Paved streets are located to the west and north of the subject property and a railroad runs along from the southern border of the subject property to the northeast. The following are general site conditions that were evaluated on the subject property and adjacent properties. 5.2.1 Aboveground Storage Tanks (ASTs) No ASTs were found on the subject property during the site reconnaissance. 5.2.2 Landfills and/or Dumping No landfills, dumping, or severely disturbed soil were found on the subject property. 5.2.3 Impoundments No impoundments were observed at the subject property. Drainage from the street and property to the north would follow the slope down to the armory and may pool on the north side of the armory building. The subject property used to have a waste water lagoon onsite directly to the east of the former armory building. 5.2.4 Monitoring Wells No monitoring wells were observed on the subject property. See Section 3.11.3 and Appendix M for monitoring wells found on adjacent properties in a search of the Oklahoma Water Resources Board records. 5.2.5 Disturbed and Stained Soils No disturbed or stained soils were noticed on the subject property. 5.2.6 Seeps No seeps of any kind were observed at the subject property. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 29 5.2.7 Chemical Spills No evidence of possible chemical spills was observed on the subject property. There were also no known chemical spills reported by the interviewee. 5.2.8 Farm Waste No farm waste was observed at the subject property. 5.2.9 Known Pesticide Misapplication No known pesticide misapplications were detected during the site visit or during the supportive research. 5.2.10 Discharges and Runoff from Adjacent Property Affecting the Site The former Sapulpa Armory is situated on a slope from north to south. The eastern side of the subject property also slopes a bit down to the east. Rainwater runs off the paved road and properties to the north onto the north side of the subject property, where it can pool. All other runoff not immediately to the north of the armory building would follow Sahoma Lake Road or topographic gradient to move past the subject property and further south or east. The property immediately to the north stores gravel and sand for the City of Sapulpa. The runoff from the subject property would follow the topographic gradient to the south or east. No other runoff from adjacent properties was observed. No potential pollutants were observed on the adjacent properties that may affect the armory. 5.2.11 Petroleum Products and Oil and Natural Gas Exploration No petroleum products or oil and natural gas exploration was observed during the site visit. 5.2.12 Asbestos Since many of the State armories were built before the 1970s, or used materials produced before the 1970s, there is a high potential of finding ACM in the armory buildings. The U.S. began banning the use of asbestos in most building products in the 1970s due to studies confirming the harmful health effects caused by exposure to airborne asbestos. ACM may be found in insulation wrapping of the heating pipes and/or heaters, roofing materials, ceiling tiles, window putty, mastic, and floor tiles. Floor tiles that are 9 x 9 inches have been found to regularly contain asbestos. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 30 DEQ’s contractor, GMR & Associates, sampled, analyzed, and assessed the armory for asbestos in February 2012. Non-friable asbestos was found in the mastic and floor tile in Room 14 and 16. The black mastic on the twelve by twelve inch brown floor tile in the hallway, covering approximately 380 square feet, was found to contain 5% and 7% chrysotile. The gray floor tiles covering approximately 250 square feet were also found to contain 10% chrysotile asbestos. The gray and white pipe insulation sampled was also found to have between 35% and 45% chrysotile asbestos. All other samples, including ceiling tiles, floor tiles, air duct mastic, drywall, carpet mastic, water elbows, and drywall dividers did not contain asbestos. DEQ collected a sample of a fallen ceiling tile on April 23, 2013 and analyzed it for asbestos. The fallen ceiling tile did not contain asbestos. The report from GMR & Associates and the lab results from the DEQ sampling are attached in Appendix O. 5.2.13 Lead DEQ has noticed the following common surfaces that have painted with lead-based paint in Oklahoma National Guard armories: doors, door frames, handrails, windows, window bars, wall trim, walls, overhead door frames, and downspouts in various places inside and outside of the building. GMR & Associates conducted a lead-based paint inspection of the former National Guard Armory building in February 2012. The lead-based paint inspection was conducted on the interior and exterior walls of the Former National Guard Armory building. The EPA’s threshold for lead-based paints is 1.0 mg/cm2. Lead-based paint was found in the ceiling of rooms 1 and 2 to contain between 5.6 mg/cm2 and 2.4 mg/cm2 lead. Lead-based paint was also found on the wall of room 19 at 2.3 mg/cm2, the exterior garage doors at 1.6 mg/cm2 to 4.3 mg/cm2, and exterior porch beam and ceiling at 2.1 mg/cm2 and 2.9 mg/cm2 respectively. No other areas that were surveyed tested positive for lead-based paint. The report from GMR & Associates is attached in Appendix O. GMR & Associates Inc. completed a Survey for Lead in Settled Dust of the former National Guard Armory building in February 2012. The EPA/HUD recommended maximum concentration for lead in settled dust is 40 micrograms per square foot (μg/ft2) for floors and 250 micrograms per square foot for window sills. Lead concentrations in settled dust exceeded these recommendations in the floor of Room 2 (71.6 μg/ft2) and on the window sill of Room 11 (421 μg/ft2). The report from GMR & Associates is attached in Appendix O. There is no IFR and associated vent fan in this building, so DEQ did not conduct any soil sampling. DEQ normally conducts soil sampling outside the vent fan of the IFR. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 31 5.2.14 Transformers/PCB Equipment Fluorescent lighting ballasts were found throughout the entire building. It is unknown if the ballasts contain PCBs. None of the ballasts appeared to have leaks. There were two pole-mounted transformers observed around the subject property, one noted to the west and one noted to the south of the subject property. It is unknown if the transformers contain PCBs, but they appeared to be in good condition. No other Polychlorinated biphenyl (PCB) contamination or other PCB-containing equipment was observed at the subject property. 5.3 External Observations The exterior of the building appears to be in good condition. The armory is currently unoccupied. There were no recognized issues with the exterior of the building. Directly to the east of the armory building there is a grassy area that is the location of the former waste water lagoon. This waste water lagoon is considered a historical recognized environmental condition (HREC). Photographs of the external view of the subject property can be found in Appendix B. 5.4 Internal Observations The building was last used by the Oklahoma Army National Guard and has been unoccupied for about a year. The one story building was constructed from brick in 1948. Before construction of the armory building, the land was owned by the Miller Pump and Supply, who bought the subject property in two sections from J. and M. Boccox and J. and Fife. During the site visit on April 23, 2013 the following issues were noted: chipped floor tiles, ceiling damage and fallen roof pieces in the drill floor and motor pool room, water damage/staining in the drill floor, wall damage, and window-sill damage. No chemicals or military equipment except for fire extinguishers were observed on the subject property. Photographs of the internal view of the subject property can be found in Appendix B. A map of the structure is included in Appendix F with notes taken by Franziska Landes during the site visit on April 23, 2013. 5.5 Interviews Former Recruiter and guard at the Sapulpa Armory, Larry Prescott, provided historical and environmental information about the subject property. He has been involved with the armory building extensively and served in Sapulpa Armory from approximately 1964 to 1996, and is, therefore, a good point of contact for knowledge of the building. He was not aware of any present environmental concerns on the subject property or adjacent properties. Below is the information obtained from Larry Prescott (Appendix B). Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 32 · There has been no industrial use of the subject property. The surrounding properties to the north, east, and south are part of an industrial park. The property to the north is a gravel and sand storage area, to the south and southeast is the railroad, and there is a material storage plant and collet plant. · Mr. Prescott knows of no chemical spills on the subject property. To his knowledge, the only chemicals used at the facility were solvents and cleaning materials used for weapon maintenance, gun oils, and motor oils. Chemicals were kept in the connex, a large metal cargo container. · Mr. Prescott is not aware of any oil exploration on the subject property or nearby. · The City of Sapulpa wants to use the building for an animal shelter. · The building did not have a formal indoor firing range, but the drill floor was used as an indoor firing range. Ammunition used included blanks and 22 caliber short range. They stopped using the drill floor as an IFR in the 1980s. · The subject property used to have a waste water treatment lagoon to the east of the armory building that has since been filled in. · There was one spill of a 55-gallon oil drum on the adjacent property to the north. EPA came out and made them dig out the spill area twice. · Mr. Prescott does not know of any hazardous air emissions on the subject property or nearby. · There was one underground storage tank that was used on the subject property in the past. Mr. Prescott is not aware of any above ground storage tanks used on the subject property. · Mr. Prescott does not know of any fill dirt, radiation signs, groundwater or surface water contamination nearby, discharges of runoff from nearby properties, and vent pipes or fill pipes, environmental lawsuits, liens or violations, wastewater discharge, unusual odors from soil, structures, or drains in the area or on the subject property. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 33 6.0 FINDINGS Summarized below are the major findings from this Targeted Brownfield Assessment and DEQ’s recommendations. The major findings of the highest environmental concern are presented first. · Other suspect ACMs, such as the ceiling tiles, were found to not contain any ACM, and are, therefore, not an issue. · There was one underground storage tank (UST) on the subject property. It had a 1,000 gallon capacity and was used to store gasoline. The tank was closed in 1981 and was removed in 1995. During the site visit on April 23, 2013, there was no sign of the UST or soil staining, and the pump island had been removed as well. The UST is considered a historical recognized environmental condition (HREC). · Seven historic dry cleaners were found within one mile of the subject property. One currently operating dry cleaner was found within a one mile radius of the subject property. It is unknown whether the dry cleaners are upgradient of the subject property, but it is possible based on the surface topography. The dry cleaners are considered a potential environmental concern (PEC) according to ASTM E 1528-06. · A former waste water lagoon was on the subject property directly to the east of the armory building. The lagoon had received various Notices of Violation from the Oklahoma Department of Environmental Quality. There was also a 1500 gallon septic tank on the subject property, and a 750 gallon septic tank that was abandoned in place in 1988 and not removed. A Memorandum dated January 9, 2001 states that the abandoned tank most likely contains liquid/sludge.The former waste water lagoon is considered a historical recognized environmental condition (HREC). · The former Sapulpa Armory was built in 1949. The land for the building was deeded by the Sapulpa Chamber of Commerce to the State of Oklahoma, on May 10, 1949 to the State of Oklahoma acting as a trustee for the Oklahoma National Guard. The subject property was managed and maintained by the Oklahoma Military Department (on behalf of the State of Oklahoma) until December 21, 2011 when the subject property was transferred to the City of Sapulpa. The subject property is currently owned by the City of Sapulpa, and the city is working to redevelop the subject property for use as an animal shelter. A Memorandum of Agreement (MOA) has been signed between the City of Okemah and the Oklahoma Department of Environmental Quality on September 6, 2011 (Appendix H). Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Creek County Courthouse. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 34 · There is one large building on the subject property. Office space in the south part of the armory building, and a drill floor and motor pool room are in the northern part of the structure. No official indoor firing range (IFR) is present on the subject property; however, interviews with site representatives revealed that the drill floor was sometimes used as a make-shift IFR. All equipment has been removed with the exception of a few heating and cooling units and a water heater. · Adjoining properties consist of the following: a gravel and sand storage area to the north, and residential area to the north of that; the Creek County District #1 county barn to the northeast; a railroad and Route 66 to the southeast and south; commercial area to the south past Route 66; the Sapulpa Golf Course to the southwest; and residential area to the immediate west, and further west is Rock Creek. The subject property is situated along the railroad tracks, and further to the northeast there has been heavy industrial development, including an oil distributer, a glass manufacturing plant, and a brick plant. · The subject property is located on the western side of the City of Sapulpa. Sanborn Fire Insurance maps do not show a detailed view of the subject property until 1961, at which point the armory building is present. Adjacent properties contained industrial and commercial buildings including the Hastings Gasoline Company, Sapulpa Brick Plant, and the Miller Combination Bailer & Pump Company. Historical aerial photographs show the various stages of the industry surrounding the subject property. The aerial image from 1941 shows mainly vacant land immediately surrounding the subject property, although industrial development is visible to the northeast of the subject property, and residential development is seen to further to the north and west. Aerial images from 1961 onward show dense industrial and commercial development to the north, east and south of the subject property. A search through county records shows that the first deed transaction on the southern portion of the subject property was in 1904 when the portion was allotted from the Muskogee (Creek) Tribe of Indians, in Indian Territory to heirs of Polly Spocogee. The first deed transaction on the northern portion of the subject property was found in 1942 when the Miller Sand Pump company sold the portion to Russell Beaty. It is unclear what development, if any, the Miller Sand Pump company had on the subject property, but one small building was visible in Track Lot C in the Sanborn map of 1921. · No National Priority List (NPL) sites, deleted NPL sites, archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) sites, Resource Conservation and Recovery Act (RCRA) subject to corrective action (CORRACTS) sites, RCRA non-corrective actions (non- CORRACTS) treatment, storage, and disposal (TSD) listings, Emergency Response Notification System (ERNS) listings, Institutional Controls/Engineering Controls, RCRA generators, Voluntary Cleanup (VCP) sites, Brownfield sites, or State landfills and/or solid waste disposal sites were found on the subject Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 35 property or within ASTM recommended search radii. The subject property is on the DEQ SCAP list for cleanup of lead and asbestos contamination. · A search for leaking underground storage tanks (LUSTs) with the ASTM search radius shows 61 LUSTs within 0.5 miles of the subject property. It is unknown whether the LUSTs are upgradient of the subject property, but it is possible based on the surface topography. · There was no record of oil and gas production on the subject property or adjoining properties in the OCC oil and gas records. · Several pole-mounted transformers were noted to west and south of the armory building. It is unknown if they contain polychlorinated biphenyls (PCBs). Fluorescent lighting ballasts are located throughout the offices, storage rooms, kitchen, and restrooms in the main armory building as well as throughout the motor pool building. The lighting ballasts all appeared to be in good condition. All fluorescent bulbs contain mercury and should be handled as Universal Waste unless documentation and/or sampling demonstrate they are not hazardous 7.0 OPINION AND RECOMMENDATIONS Due to the past use of the subject property and the contamination found on the subject property, it is believed that cleanup of lead and asbestos will be necessary. 8.0 DATA GAPS No tribal information was obtained for this assessment. No tax records, city directories, or zoning records were reviewed for this report. A data gap exists from the aerial photos between 1941 and 1969, and between 1969 and 1995. Since the subject property does not appear on Sanborn maps, there is no direct knowledge of what occurred on the subject property until 1961 other than what is shown in aerial photographs and topographic maps. However, this did not affect the ability of the DEQ to make a recommendation on the subject property. 9.0 CONCLUSIONS We have performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-05 of the Former Sapulpa Armory located at 13 Sahoma Lake Road, Sapulpa, Creek County, Oklahoma. Any exceptions to, or deletions from, this standard are described in Section [11.0] of this report. This assessment has revealed no evidence of recognized environmental conditions in Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 36 connection with the subject property except for the following: lead dust, lead-based paint, and asbestos contamination throughout the building. The information provided in this assessment is to assist the City of Sapulpa in its revitalization planning as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund – Ref. 2), as provided in the Small Business Relief and Brownfields Revitalization Act of 2002 (Public Law 107-118, Subtitle B – Ref. 3). 10. ADDITIONAL SERVICES In addition to this Phase I Targeted Brownfield Assessment, DEQ has provided sampling analysis of potential asbestos, lead-based paint, and lead dust sources. The DEQ Site Cleanup Assistance Program is in charge of identifying environmental hazards and conducting the cleanup of lead and asbestos at the Armory. 11. DEVIATIONS The following deviations from ASTM Practice E 1527-05 occur in this Phase I Targeted Brownfield Assessment. No tax records, city directories, or zoning records were reviewed for this report. The ASTM Phase I Environmental Site Assessment E 1527 – 05 is the minimum standard for environmental due diligence in the commercial real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfields Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the redevelopment project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. The subject property is situated in the north half of the Northeast Quarter of the Northeast Quarter of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis and San Francisco Railway right-of-way. The purpose of the TBA was to identify potential environmental concerns by reviewing historical data, regulatory information, and by performing a visual inspection of the subject property and surrounding area. The following is an executive summary of the environmental site assessment results: · Results from the lead and asbestos surveys found that the subject property is contaminated with lead dust, lead-based paint, and asbestos. The Oklahoma Department of Environmental Quality Site Cleanup Assistance Program (SCAP) plans to remediate the lead and asbestos contamination on the subject property and properly dispose of all associated waste. The lead dust, lead-based paint, and asbestos contamination in the building constitute recognized environmental conditions (RECs). · DEQ collected a sample of a fallen ceiling tile on April 23, 2013 and analyzed it for asbestos. The fallen ceiling tile did not contain asbestos. See Appendix O for lab results. · DEQ’s contractor, GMR & Associates, performed an asbestos survey on the subject property in February 2012. Non-friable asbestos was found in the mastic and floor tile in Room 14 and 16. The asbestos containing materials are a REC. · There was one underground storage tank (UST) on the subject property. It had a 1,000 gallon capacity and was used to store gasoline. The tank was closed in 1981 and was removed in 1995. During the site visit on April 23, 2013, there was no sign of the UST or soil staining, and the pump island had been removed as well. The UST is considered a historical recognized environmental condition (HREC). · Seven historic dry cleaners were found within one mile of the subject property. One currently operating dry cleaner was found within a one mile radius of the subject property. It is unknown whether the dry cleaners are upgradient of the subject property, but it is possible based on the surface topography. The dry cleaners are considered a potential environmental concern (PEC) according to ASTM E 1528-06. · A former waste water lagoon was on the subject property directly to the east of the armory building. The lagoon had received various Notices of Violation from the Oklahoma Department of Environmental Quality. There was also a 1500 gallon septic tank on the subject property, and a 750 gallon septic tank that was Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 6 abandoned in place in 1988 and not removed. A Memorandum dated January 9, 2001 states that the abandoned tank most likely contains liquid/sludge. The former waste water lagoon is considered a historical recognized environmental condition (HREC). · The former Sapulpa Armory was built in 1949. The land for the building was deeded by the Sapulpa Chamber of Commerce to the State of Oklahoma, on May 10, 1949 to the State of Oklahoma acting as a trustee for the Oklahoma National Guard. The subject property was managed and maintained by the Oklahoma Military Department (on behalf of the State of Oklahoma) until December 21, 2011 when the subject property was transferred to the City of Sapulpa. The subject property is currently owned by the City of Sapulpa, and the city is working to redevelop the subject property for use as an animal shelter. A Memorandum of Agreement (MOA) has been signed between the City of Okemah and the Oklahoma Department of Environmental Quality on September 6, 2011 (Appendix H). Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Creek County Courthouse. · There is one large building on the subject property. Office space in the south part of the armory building, and a drill floor and motor pool room are in the northern part of the structure. No official indoor firing range (IFR) is present on the subject property; however, interviews with site representatives revealed that the drill floor was sometimes used as a make-shift IFR. All equipment has been removed with the exception of a few heating and cooling units and a water heater. · Adjoining properties consist of the following: a gravel and sand storage area to the north, and residential area to the north of that; the Creek County District #1 county barn to the northeast; a railroad and Route 66 to the southeast and south; commercial area to the south past Route 66; the Sapulpa Golf Course to the southwest; and residential area to the immediate west, and further west is Rock Creek. The subject property is situated along the railroad tracks, and further to the northeast there has been heavy industrial development, including an oil distributer, a glass manufacturing plant, and a brick plant. · The subject property is located on the western side of the City of Sapulpa. Sanborn Fire Insurance maps do not show a detailed view of the subject property until 1961, at which point the armory building is present. Adjacent properties contained industrial and commercial buildings including the Hastings Gasoline Company, Sapulpa Brick Plant, and the Miller Combination Bailer & Pump Company. Historical aerial photographs show the various stages of the industry surrounding the subject property. The aerial image from 1941 shows mainly vacant land immediately surrounding the subject property, although industrial development is visible to the northeast of the subject property, and residential development is seen to further to the north and west. Aerial images from 1961 Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 7 onward show dense industrial and commercial development to the north, east and south of the subject property. A search through county records shows that the first deed transaction on the southern portion of the subject property was in 1904 when the portion was allotted from the Muskogee (Creek) Tribe of Indians, in Indian Territory to heirs of Polly Spocogee. The first deed transaction on the northern portion of the subject property was found in 1942 when the Miller Sand Pump company sold the portion to Russell Beaty. It is unclear what development, if any, the Miller Sand Pump company had on the subject property, but one small building was visible in Track Lot C in the Sanborn map of 1921. · No National Priority List (NPL) sites, deleted NPL sites, archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) sites, Resource Conservation and Recovery Act (RCRA) subject to corrective action (CORRACTS) sites, RCRA non-corrective actions (non- CORRACTS) treatment, storage, and disposal (TSD) listings, Emergency Response Notification System (ERNS) listings, Institutional Controls/Engineering Controls, RCRA generators, Voluntary Cleanup (VCP) sites, Brownfield sites, or State landfills and/or solid waste disposal sites were found on the subject property or within ASTM recommended search radii. The subject property is on the DEQ SCAP list for cleanup of lead and asbestos contamination. · A search for leaking underground storage tanks (LUSTs) with the ASTM search radius shows 61 LUSTs within 0.5 miles of the subject property. It is unknown whether the LUSTs are upgradient of the subject property, but it is possible based on the surface topography. · There was no record of oil and gas production on the subject property or adjoining properties in the OCC oil and gas records. · Several pole-mounted transformers were noted to west and south of the armory building. It is unknown if they contain polychlorinated biphenyls (PCBs). Fluorescent lighting ballasts are located throughout the offices, storage rooms, kitchen, and restrooms in the main armory building as well as throughout the motor pool building. The lighting ballasts all appeared to be in good condition. All fluorescent bulbs contain mercury and should be handled as Universal Waste unless documentation and/or sampling demonstrate they are not hazardous. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 8 2.0 INTRODUCTION The State of Oklahoma Department of Environmental Quality (DEQ) under a Brownfield Assistance Agreement (No. RP96681001-0) (Ref. 1) with the U.S. Environmental Protection Agency (EPA) conducted a Targeted Brownfield Assessment of a property located at 13 Sahoma Lake Road, Sapulpa, Creek County, Oklahoma. 2.1 Purpose The purpose of this assessment is to look at the environmental conditions within the target area and provide this information to the City of Sapulpa as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund) (Ref. 2), as provided in the Small Business Relief and Brownfield’s Revitalization Act of 2002 (Public Law 107-118, Subtitle B) (Ref. 3). The purpose of a Phase I Environmental Site Assessment is to identify, to the extent feasible, recognized environmental conditions in connection with the subject property through a systematic review of readily available information sources and a site reconnaissance. DEQ is providing technical assistance to the project by evaluating the environmental condition of the subject property prior to the City of Sapulpa converting the Former Sapulpa National Guard Armory Building for use as an animal shelter. Funding for this assessment has been provided by the EPA. 2.2 Detailed Scope-of-Services DEQ examined the current use of the subject property and identified the historical uses of the subject property to determine if recognized environmental conditions exist. DEQ examined historical documents, governmental databases, oil and gas records, aerial photographs, Sanborn Fire Insurance Maps, and conducted interviews and a site reconnaissance of the area. A good faith effort was made to identify possible environmental conditions that might affect the development of the subject property. 2.3 Significant Assumptions History and knowledge of the subject property shows that the building was used as a National Guard Armory. The National Guard Amory was built in 1949, and the subject property was mostly vacant land with one small building until 1949 when the Sapulpa Chamber of Commerce deeded the subject property to the State of Oklahoma for use as a National Guard Armory. There has been no oil and gas exploration on the subject property according to Oklahoma Corporation Commission records. Since the building was constructed in the 1948, the building may contain ACM. The U.S. began banning the use of asbestos in most building materials in the 1970s due to Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 9 studies confirming the harmful health effects caused by exposure to airborne asbestos. Insulation, floor tile, and mastic observed in the building during site reconnaissance conducted on April 23, 2013, have been confirmed to contain asbestos. DEQ’s contractors performed a lead and asbestos survey on the subject property. Lead-based paint, lead dust, and asbestos containing materials were found in the building. Details are included in Section 5.2 General Site Assessment and in Appendix O. 2.4 Limitations and Exceptions The purpose of an environmental site assessment is to identify actual or potential “recognized environmental conditions” that may result in liability, land use restrictions, or cause delays in revitalization. The ASTM Phase I Environmental Site Assessment E 1527 – 05 (Ref. 4) is the minimum standard for environmental due diligence in the real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfields Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the revitalization project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. This assessment was conducted under constraints of time, cost, and scope and reflects a limited investigation and evaluation. It reflects the normal degree of care and skill that is ordinarily exercised by environmental professionals conducting business in this or similar localities. In no event shall the DEQ or its employees be liable for any damages, injury, loss, cost, or expense whatsoever arising in connection with the use or reliance on the information contained in this report, except as otherwise provided by law. The information in this report is based on a review of governmental records, interviews with knowledgeable representatives of the property, information provided by the City of Sapulpa, and observations of the environmental professional. The result of this assessment, as written in this report, is valid as of the date of report. The assessment does not include sampling of rock, groundwater, surface water, or air. For qualifications of environmental professionals see Appendix A. 2.5 Special Terms and Conditions This assessment report has been prepared for the City of Sapulpa by the DEQ using EPA funding. Information about this report will be provided to the EPA for its files. This report and the working file are public record and subject to the Oklahoma Open Records Act and the federal Freedom of Information Act. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 10 3.0 SITE CHARACTERIZATION AND HISTORY 3.1 Location and Legal Description The subject property is to the east of Sahoma Lake Road, to the northwest of Highway 66, and to the south of W. Thompson Avenue, at 13 Sahoma Lake Road, Sapulpa, Oklahoma, 74066 in Creek County. The subject property is located at latitude 35.996157 and longitude -96.129820. The subject property consists of approximately 1.8 acres of land and contains the former National Guard Armory. A site map and topographical map depicting the subject property have been provided in Appendix F. The subject property is located in the SE ¼ of the SE ¼ of the NW ¼ and the NE ¼ of the NE ¼ and the SW ¼ of Section 34, Township 18 North, and Range 11 East of the Indian Meridian, lying North and West of the St. Louis and San Francisco Railway right-of- way in Creek County, Oklahoma. The subject property’s legal location is described as follows: The West 275 feet of Trackage Lot “C” in Westport Addition to the City of Sapulpa, Creek County, Oklahoma, less a tract thereof described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the point of beginning; and All that part of the N ½ of the NE ¼ of the NE ¼ of the SW ¼ of the Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way. Creek County Courthouse Records showed the following history on the subject property (See Appendix G). · On March 26, 1904, the southern portion of the subject property described as “N½ of NE ¼ of NE ¼ of SW ¼ (less .92 Acres for St. Louis & San Francisco R.R. Right of Way) of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way” was allotted from the Muskogee (Creek) Tribe of Indians, in Indian Territory to heirs of Polly Spocogee. · On February 7, 1925, Timmie Fife and Sarah Fife, sold the southern portion of the subject property described as “All that part of the NE ¼ of the NE ¼ of the SW ¼ Section Thirty (34) Four, Township Eighteen (18), Range Eleven (11), lying North and West of the St. L and S F Right of way” to the Miller Combination Bailer & Pump Company. · On December 15, 1942, Miller Sand Pump company sold the subject property described as “Block “C” in the Westport Addition to Sapulpa, Creek County, Oklahoma, according to the recorded plat thereof, and That part of the NE ¼ of the NE ¼ of the SW ¼ of the Section 34, Township 18 North, Range 11 East, Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 11 lying North and West of the St. Louis & San Francisco Railway right-of-way” to Russell Beaty. · On July 6, 1944, Russel Beaty and Oneida Beaty sold the subject property described as “Trackage Lot “C” Westport addition to the City of Sapulpa, except a tract beginning at the Northwest corner of said Lot “C”, thence North 150 feet to the point of beginning, also except right-of-way of St. L. S. F. Railroad Company, and that part of the NE ¼ of the NE ¼ of the SW ¼ of Section 34-18-11 East I.M. lying North of the St. Louis San Francisco Railway Company’s right-of-way” to J.M. Bocox and Mattie B. Bocox. · On December 6, 1948, the Miller Sand Pump company, successor to The Miller combination Bailer and Pump company, sold a portion of the subject property described as “all that part of the North Half of the Northeast Quarter of the Northeast Quarter of the Southwest Quarter of Section 34, Township 18 North, Range 11 East, lying and situated North and West of the St. Louis & San Francisco Railroad right-of-way” to J.M. Bocox and Mattie B. Bocox. · On February 3, 1949, J.M. Bocox and Mattie B. Bocox, granted the subject property described as “all that part of the N ½ of NE ¼ of NE ¼ of SW ¼ of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way, and Trackage Lot “C” in Westport Addition to the City of Sapulpa, less a tract therein, particularly described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the place of beginning” to the Sapulpa Chamber of Commerce. · On May 10, 1949, the Sapulpa Chamber of Commerce granted the subject property described as “the West 275 feet of Trackage Lot “C” in Westport Addition to the City of Sapulpa, Creek County, Oklahoma, less a tract thereof described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the point of beginning; and, all that part of the N ½ of NE ¼ of NE ¼ of SW ¼ of Section 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way” to the State of Oklahoma, acting as trustee for the Oklahoma National Guard. · On December 21, 2011, the State of Oklahoma, acting by and through the Oklahoma Military Department granted the subject property described as “the West 275 feet of Trackage Lot “C” in Westport Addition to the City of Sapulpa, Creek County, Oklahoma, less a tract thereof described as beginning at the Northwest corner of said Lot “C”, thence East 125 feet, thence South 150 feet, thence West 125 feet, thence North 150 feet to the point of beginning; and, all that part of the N ½ of NE ¼ of NE ¼ of SW ¼ of Sec tion 34, Township 18 North, Range 11 East, lying North and West of the St. Louis & San Francisco Railway right-of-way” to the City of Sapulpa, Oklahoma. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 12 3.2 Site and Vicinity Characterization The former Sapulpa Armory was built in 1949. According to Creek County land records, the land for the building was owned by Sapulpa Chamber of Commerce and deeded to the State of Oklahoma, acting as a trustee for the Oklahoma National Guard on May 10, 1949 (see Appendix G). The subject property is a tract of land about 1.8 acres in size, and is located at 13 Sahoma Lake Rd., Sapulpa, Oklahoma 74066. The area where the subject property and adjacent properties are located is best characterized as a mixture of residential, commercial, and industrial space. To the west there is residential property and further west is Rock Creek. To the north is a sand and gravel storage area and further to the north is more residential area. To the northeast is the county barn for Creek County District #1. To the east, southeast, and south of the subject property is a railroad and the Route 66. Past the highway to the south is a commercial area and to the southwest is the Sapulpa Golf Course. A review of the topographical map indicated that the surface elevation of the subject property is approximately 650 feet above mean sea level. The subject property is situated on a slope and the topographical gradient is south southeast, toward the railroad and Route 66. The topographical map can be found in Appendix F. 3.3 Description of Structures, Roads, and Other Improvements The subject property consists of the former armory building. Chipped floor tiles were observed in the entrance to room 13. The drill floor and motor pool room had damaged ceiling tiles and fallen pieces were observed on the floor. Pooling water was also observed in the drill floor. Peeling paint was observed on several window sills. Peeling paint and wall damage was also noticed in the former armory building, in particular in the motor pool room (room 2). Roads surrounding the Armory are paved with asphalt. Photos can be found in Appendix B and a map indicating the room numbers can be found in Appendix B and F. 3.4 Owner, Property Manager, and Occupant Information The subject property is owned by the City of Sapulpa and is currently unoccupied. The DEQ Site Cleanup Assistance Program is in charge of identifying environmental hazards and conducting the lead and asbestos cleanup of the Armory. The Oklahoma Military Department transferred ownership of the armory to the City of Sapulpa prior to completion of remedial activities (Appendix G). 3.5 Information Reported by User Regarding Environmental Lien or Specialized Knowledge or Experience The property owner and/or representatives reported no environmental liens on the subject property and had no specialized knowledge or experience regarding recognized environmental conditions. The DEQ conducted a search for environmental liens at the Creek County Courthouse. No environmental liens or use limitations were reported for the subject property, and it does not appear in the Brownfield IC database. Following Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 13 abatement of lead and asbestos on the subject property, a deed notice will be placed on the subject property by DEQ. 3.6 Commonly Known or Reasonably Ascertainable Information Ted Fischer, Director of Economic Development for the City of Sapulpa, had no exceptional knowledge of commonly known or reasonably ascertainable information about possible environmental conditions on the subject property. It is known within the community that the building functioned as a National Guard Armory. A Memorandum for Record documenting a Site Assistance Visit (SAV) on April 16, 2009 states the following: · Background: the Sapulpa Armory (Sapulpa Readiness Center) was constructed in 1949, is approximately 9,880 square feet in size and is situated on approximately 3.0 acres. · Adequate secondary containment was not present for hazardous materials and POLs (Petroleum, Oils, and Lubricants) stored in the conex. · The facility is zoned commercial general (CG), and is bordered by trees and residential zoned land to the north; to the south is the Burlington Railroad and Highway 66, and agricultural zoned land; further southeast is industrial moderate zoned land; to the west is Sahoma Lake Road and agricultural zoned land; to the ease is Creek County Commissioners commercial general zoned land. Probably wetlands are located approximately 655 feet to the west and approximately 1,400 feet to the west, southwest. 3.7 Valuation Reduction for Environmental Issues Valuation of the subject property is outside the scope of this assessment. A professional appraiser should be consulted to place a value on the subject property. 3.8 Current Use of the Property The buildings are currently empty. The rest of the subject property is vacant land. 3.9 Past Use of the Property 3.9.1 Review of Aerial Photographs Historic aerial photographs were searched to view the changes to the subject property over time. The 1941 aerial photograph was found at the Oklahoma Department of Libraries. The 1969 aerial photograph was found in the records at the Oklahoma Department of Environmental Quality. The aerial photographs from 1995, 2003, 2004, 2005, 2006, 2008, 2010, 2011 and 2012 were found on Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 14 Google Earth. All of these photographs are located in Appendix C. The following represents a summary of what was found at the subject property from each photograph. 1941 aerial photograph The 1941 aerial photograph shows the subject property to be primarily vacant land, with one small building on the southwestern corner, near a road and the railroad. The adjacent property to the north is vacant land and further north development appears to be residential. The adjacent property to the northeast and east also are vacant land. The subject property is bordered to the south and southeast by a railroad running diagonally from the southwest to the northeast. Next to and parallel to the railroad is a larger road. There is a building on the adjacent property to the west, beyond which is Rock Creek. The structures associated with the armory are not present in the photograph. 1969 aerial photograph The 1969 aerial photograph shows the subject property with the armory building present. The small building noted in the 1941 aerial is no longer present. The railroad borders the subject property on the southeast and south and a wide road runs parallel to the railroad. South of the road more industrial or commercial developments have been built. There is a building on the adjacent property to the west, beyond which is Rock Creek. 1995 aerial photograph The 1995 aerial photograph shows the armory building on the subject property. A lagoon is visible on the subject property to the east of the armory building. The adjacent property to the north appears to be used for gravel and sand storage and there are several structures on the adjacent property to the northeast. The building across the street to the west also remains. 2003 aerial photograph The 2003 aerial photograph shows some changes from the 1995 aerial photograph. The lagoon on the subject property appears to be filled in or is no longer present. 2004 aerial photograph The 2004 aerial photograph shows no significant changes from the 2003 aerial photograph. 2005 aerial photograph The 2005 aerial photograph shows no significant changes from the 2004 or the 2003 aerial photograph. 2006 aerial photograph Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 15 The 2006 aerial photograph shows some changes from the 2005 aerial photograph. No significant changes are noticed on the subject property or immediately adjacent properties. On the property further to the northeast that appeared to be an auto salvage yard, the cars are no longer visible. 2008 aerial photograph The 2008 aerial photograph shows no significant changes from the 2006 aerial photograph. 2010 aerial photograph The 2010 aerial photograph shows no significant changes from the 2008 or the 2006 aerial photograph. 2011 aerial photograph The 2011 aerial photograph shows no significant changes from the 2010, 2008 or 2006 aerial photograph. 2012 aerial photograph The 2012 aerial photograph shows no significant changes from the 2011, 2010, 2008 or 2006 aerial photograph. 3.9.2 Fire Insurance Maps · Sanborn Fire Insurance maps were viewed and downloaded from the Oklahoma Department of Libraries website (Ref. 6). Sanborn maps of the city of Sapulpa were found for 1911, 1915, 1920, 1929, and 1929-1961. The subject property is seen as “Track Lot C” in the Sanborn overview maps for 1915, 1920, 1929, and 1929-1969, but is not shown in a close-up map until 1929-1961. Sanborn maps are in Appendix E. · The 1920 Sanborn map does not show a close-up view of Track Lot C, but shows that the Sapulpa Brick Plant operated on Track Lot B to the northeast of the subject property and shows Sunflower Glass Company, Manufacturers of Window Glass, on the property to the southeast of the Sapulpa Brick Plant. · The 1929 Sanborn map does not show a close-up view of Track Lot C, but shows formerly Hastings Gasoline Company on Track Lot B to the northeast of the subject property. Miller Combination Bailer & Pump Company is also on Track Lot B. One small structure is seen on Track Lot C on the other side of N. Wallace Road. United Brick and Tile Company, Sapulpa Plant is located in Track Lot A, further northeast of Track Lot B. Sunflower Glass Company, leased by Victory Window Glass Company is across the street and railroad from Track Lot A. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 16 · The 1929-1961 Sanborn shows the armory on the subject property in Track Lot C. Wickham Packing Company and Feed Stock Pens are present in Track Lot A. And the Sapulpa Brick Company is still across the railroad to the south of Track Lot A. 3.10 Current and Past Uses of Adjoining Properties The aerial images from 1941 and 1969 show the development of the subject property and the adjoining properties. 1941 aerial photograph The adjacent property to the north is vacant land, and further north development appears to be residential. The adjacent property to the northeast and east also are vacant land. Further to the east northeast appears to be a larger industrial complex. The subject property is bordered to the south and southeast by a railroad running diagonally from the southwest to the northeast. Next to and parallel to the railroad is a larger road. South of the road some structures are apparent, but it is unclear of what type. There is a building on the adjacent property to the west, beyond which is Rock Creek. The structures associated with the armory are not present in the photograph. 1969 aerial photograph Development can be seen on the adjacent property to the north, though it cannot be determined what kind of development. Several structures have been built on the adjacent property to the northeast. The industrial area to the northeast remains. The railroad borders the subject property on the southeast and south, and a wide road runs parallel to the railroad. South of the road more industrial or commercial developments have been built. There is a building on the adjacent property to the west, beyond which is Rock Creek. 1995 aerial photograph The adjacent property to the north appears to be used for gravel and sand storage, and there are several structures on the adjacent property to the northeast. Further to the northeast there appears to be an auto salvage yard, and the industrial area to the northeast still remains. Commercial development is still present south of the railroad. The building across the street to the west also remains. 2003-2005 aerial photograph The 2003, 2004, and 2005 show no significant changes in the adjacent properties. 2006 aerial photograph On the property further to the northeast that appeared to be an auto salvage yard, the cars are no longer visible. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 17 2008-2012 aerial photograph The 2008, 2010, 2011, and 2012 aerial photograph shows no significant changes from the 2006 aerial photograph. Interviews with past occupants revealed the following other past uses of adjoining properties: · The property directly to the north is used for gravel and sand storage. To the northeast is the county barn for district #1. There was a spill of a 55-gallon oil drum around 1992. EPA made them dig it out twice. · The property to the east is grassy, vacant land, and then there is the railroad. Directly to the east of the armory building there used to be a lagoon on the subject property. · The property to the south is also grass, then a parking lot, then the railroad, then Route 66, followed by the Sapulpa Golf Course. · To the west is a road, then a few residential properties. During the site visit on April 23, 2013, adjoining properties were observed to contain the following: · To the north of the subject property is an area that appears to be a gravel storage location. The topography slopes upward to the north. · To the east of the subject property is vacant land and then the railroad. · To the south of the subject property is the railroad and then Route 66. The topography slopes downward to the south. · To the west of the subject property appears to be residential buildings. 3.11 Environmental (Physical) Setting The DEQ reviewed several sources to obtain information on the physical setting of the subject property and its surrounding areas. These sources include: The United States Department of Agriculture Oklahoma County Soil Survey, Oklahoma Geological Survey, Oklahoma Water Resource Board data viewer, and the Federal Emergency Management Association. Review of the physical setting of the area is to evaluate the sensitivity of the hydrogeology to potential contamination from sources either on or near the subject property. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 18 3.11.1 Surface Water Characteristics The topography of the area is very sloped. The former Sapulpa Armory is located at a surface elevation of approximately 650 feet above mean sea level and the area slopes from the north down to the south. The topographical gradient is to the south-southeast towards the railroad and Route 66. Rock Creek is located approximately 0.13 miles west of the subject property. There is no public water supply intake point within a 1 mile radius of the subject property. The public water supply intake for the City of Sapulpa is Lake Sahoma, approximately 2.6 miles north of the subject property, and Skiatook Lake, approximately 21 miles to the north of the subject property. No surface water bodies are on the subject property. There used to be a waste water lagoon on the subject property. Records of a Survey of Lagoon/Septic Systems conducted by the Oklahoma Military Department in 2000 show that the lagoon had overflow problems. Additional comments are noted below and the complete document can be found in Appendix P. · There were septic tanks on the subject property. As of 2000, there was an existing 1500 gallon oval tank. There was also a nearby rectangular tank of approximately 750 gallons that was abandoned in place in 1988 and not removed. It was presumed that the 750 gallon tank most likely contained liquid/sludge. · The lagoon was reported to fail to meet the needs of the Armory for several years and reflux of waste into the armory is not unusual. The lagoon system was determined to likely be of insufficient size and volume to accept required waste loading. · The Sapulpa Armory received Notice of Violation citations from the Oklahoma Department of Environmental Quality for periodic impoundment overflow and vegetative growth. According to the Federal Emergency Management Association (FEMA), the subject property is in Zone X flood plain and in an area adjacent to, but outside of, the Zone AE flood plain. According to FEMA (Ref. 15), Zone AE is the area subject to inundation by the 1-percent-annual-chance flood event determined by detailed methods. Zone X is the area of minimal flood hazard, which is higher than the elevation of the 0.2-percent-annual-chance flood. A map of this information is located in Appendix D. The subject property obtains its drinking water from the City of Sapulpa, which uses Sahoma Lake and Lake Skiatook for its water source. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 19 3.11.2 Subsurface Geological Characterization According to the Soil Survey of Creek County, Oklahoma, the subject property soils are composed approximately 55% of Dennis and Okemah Soils with 3% to 5% slope and 45% of Collinsville and Talihina soils with 12% to 20% slope. Collinsville and Talihina soils exhibit 12 to 20 percent slopes, are found on hillslopes and the backslope, and are somewhat excessively drained to moderately well drained. The depth to water table is about more than 80 inches and bedrock is 8 to 20 inches deep for the Collinsville soils and 6 to 21 inches and 6 to 20 inches respectively for the Talihina soils. Dennis and Okemah soils exhibit 3 to 5 percent slopes, are found on hillslopes and paleoterraces, and are somewhat poorly drained. The depth to water table is about 12 to 30 inches. Dennis and Okemah soils both have a high available water capacity (about 10.7 inches). 3.11.3 Ground Water Characteristics The hydrogeology as reported by the Oklahoma Water Resources Board (OWRB) indicates that there is no major or minor aquifer in this area. The OWRB Reported Well Log Viewer was utilized to make a map of groundwater and monitoring wells within a 0.5 and a 1 mile radius of the subject property. The closest groundwater well to the subject property is located 0.5 miles southeast and is used for domestic purposes. There are 23 monitoring wells within 0.5 miles of the subject property, all used for site assessment. The majority of the monitoring wells are from Clark Oil Distributors, 0.35 miles to the northeast of the subject property. There was one Other Well, used for soil evaluation 0.1 mile east of the subject property. For a list and map of wells that are within 1 mile of the subject property, see Appendix M. 3.11.4 Air Characteristics No air emissions were noticed at the subject property or the adjoining properties. The DEQ dataviewer database was searched for Air Quality Permitted Facilities (AQPF) and 2010 Point Source Emissions. No AQPF was found. One 2010 Point Source Emissions was found within 1 mile radius from the subject property. · Renwood Cleaners located at 120 S Park, Sapulpa, Oklahoma 74066 is 0.98 miles to the east of the subject property. SIC Code: 7216; Company ID: 1964; and Facility ID:4096. Emissions: 2.285 tons of VOC. Report Generated on 12/14/2011. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 20 No odors were noticed outside of the subject property during the site visit. However, there is a potential for lead dust and asbestos emissions from the subject property. 4.0 RECORDS REVIEW A regulatory database search was conducted by the DEQ. This search included, at a minimum, those records and distances from the subject property dictated as appropriate in the ASTM standard. The DEQ performed a review of available federal and state databases to assess whether the subject property or proximate properties were listed as having environmental concerns, which could have an adverse impact on the subject property. The following provides a summary of the databases reviewed. 4.1 Federal National Priorities List (NPL) The EPA database was searched for NPL sites near the subject property within the ASTM’s recommended search radius of one mile (Ref. 8). The subject property is not a listed NPL site. There are no NPL sites reported within a one-mile radius of the subject property. There is also an EPA database for Deleted NPL sites, which ASTM requires to be reported within ½ mile of the subject property (Ref. 9). No deleted NPL sites are within the ½ mile search radius. A list of all sites in Oklahoma on the NPL, Deleted NPL, Proposed NPL, Partially NPL, and Construction Completion NPL sites is included in Appendix N. 4.2 Federal CERCLIS List The EPA database for Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) Information Systems (CERCLIS) was searched for active and archived CERCLIS sites on and near the subject property (Ref. 10). The ASTM’s recommended search radius of the subject property for both active and archived CERCLIS sites is ½ mile. No active CERCLIS sites were found within ½ mile of the subject property. The subject property is not listed on the archived CERCLIS list. The search result is included in Appendix N. 4.3 Federal RCRA CORRACTs List The EPA database for RCRA facilities subject to corrective action was searched within the ASTM’s required minimum distance of one mile of the subject property (Ref. 11). No RCRA CORRACT facility was found within the one-mile radius of the subject property. The search result is included in Appendix J. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 21 4.4 Federal RCRA non-CORRACTS TSD List The EPA database for RCRA facilities not subject to corrective action was searched within the ASTM’s required minimum distance of ½ mile of the subject property (Ref. 11). No RCRA non-CORRACT Treatment, Storage, and Disposal (TSD) sites are within the ½ mile radius of the subject property. The search result is included in Appendix J. 4.5 Federal RCRA Generators List The EPA RCRA Notifiers and DEQ RCRA Notifiers databases were searched for RCRA generators within the ASTM’s required minimum search distance of the subject property (Ref. 11,16). The minimum distance is the property and adjoining properties. The subject property did not have any RCRA notifiers or generators. No large quantity generators or small quantity generators were reported within the subject property and its adjoining properties. However, several small quantity generators, large quantity generators, and conditionally exempt generators were found in the City of Sapulpa. The search result is included in Appendix J. ASTM requires a minimum search distance of the subject property only when identifying ERNS cases. No ERNS sites were reported within the property or the adjoining properties. The ERNS data for all results near the City of Sapulpa is included in Appendix I. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 22 4.7 Federal Institutional Control/Engineering Control Registries Federal Institutional Control/Engineering Control registries are under development, but not available at this time. There are no known Institutional Controls/Engineering Controls on the subject property according to the representatives of the subject property and a search of county land records. 4.8 State-Equivalent NPL DEQ does not have a State-equivalent NPL database. Oklahoma does not have a State Superfund law to establish a State-equivalent NPL database. 4.9 State-Equivalent CERCLIS DEQ does not have a State-equivalent CERCLIS database. 4.10 State Landfill and / or Solid Waste Disposal Sites DEQ regulates landfills and solid waste disposal sites across the State of Oklahoma (Ref. 13). State landfills and solid waste disposal facilities were searched in the DEQ database within the ASTM required minimum distance of ½ mile from the subject property. No permitted landfills or solid waste disposal facilities are located within the search distance of the subject property. 4.11 State Leaking UST List The Oklahoma Corporation Commission UST Notification Database and the OWRB data viewer were searched to locate any known LUSTs sites located within the ASTM’s minimum search distance of a ½ mile of the subject property. OWRB found 61 LUST sites within the ½ mile radius, 49 of which belonged to Clark Oil Distributors. OWRB information and map of all LUST sites found within ½ mile are included in Appendix M. Information from OCC on LUST cases, including detailed records, are included in Appendix L. · Clark Oil Distributors, Inc. is located at 801 W. Dewey, Sapulpa, Creek County, Oklahoma 74066 (35.998188,-96.124593). The facility number is 1902111, Case Number 064-3043. There are 55 tanks reported for this site ranging from 1000 to 12,000 gallon in size and including 44 above ground storage tanks (ASTs) and 11 underground storage tanks (USTs). Of the ASTs, 42 are currently in use, one is temporarily out of use and one is permanently out of use; of the USTs two are currently in use and 9 are currently out of use. The tanks are for retail and distributing and hold a variety of materials including gasoline, diesel, kerosene, hydraulic fluid, motor oil, and methanol. All tanks installed before 2000 are permanently out of use. The Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 23 tanks in use were installed between 2000 and 2010. The site is currently active. The most recent document showing case closure is included in Appendix L. · Former Pretty Quick #2 is located at 1000 W Dewey, Creek County, Sapulpa, Oklahoma (35.996227, -96.127061). The facility number is 1910625 and the case number is 064-RW. Another case 064-3257 was found to be related to this case, and a letter detailing the request to deactivate case 064-3257 and reopen the closed case 064-RW, because they are related to the original 064- RW case. There are 5 tanks reported for this site and all are permanently out of use. Three tanks were installed in 1974 and held up to 2,000, 3,000, and 10,000 gallons of gasoline. One 4000 gallon tank was installed in 1991 for gasoline and another 4,000 gallon tank was installed in 1998 for diesel. The tanks were closed in 2007 and 2008. Documents and information about the LUST case can be found in Appendix L. · Johnson’s Mini Mart is located at 701 W. Dewey Sapulpa, Creek County, Oklahoma (35.998114, -96.121501). The facility number is 1913107, and the case number is 064-1946. The case is closed. The site is inactive. There are three tanks reported for this site and all are permanently out of use. A 6,000 gallon tank that held diesel was installed in 1989 and closed in 1997. The 10,000 gallon tank that held gasoline was installed in 1980 and closed in 1997. Documents and information about the LUST case can be found in Appendix L. · US #1 is located at 420 W. Dewey, Sapulpa , Creek County, Oklahoma (35.998232, -96.11963). The facility number is 1912612 and the case number is 064-3293. The case is open. The site is inactive. There are three tanks reported for this site, all held gasoline, and all are permanently out of use. One tank is of an unknown size and was closed in 1980. The other two tanks, one 4,000 gallons and one 8,000 gallons, were installed in 1983 and were closed in 1999 and 2011 respectively. Documents and information about the LUST case can be found in Appendix L. · City of Sapulpa Central is located at 410 S. Hawthorn, Sapulpa, Creek County, Oklahoma (35.993563, -96.127798). The facility number is 1906041. The LUST case was closed in 11/9/1994 and the facility was closed in 2000. There were two tanks reported for this site and both are permanently out of use. The 8,000 gallon gasoline tank and the 8,000 gallon diesel tank were both installed in 1980 and closed in 1996. Documents and information about the LUST case can be found in Appendix L. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 24 4.12 State Registered UST Sites The Oklahoma Corporation Commission UST Notification Database was searched to locate registered USTs located within the ASTM’s minimum search distance of the subject property and its adjoining properties. There were was one former registered UST on the subject property. A record from the Oklahoma Military Department dated October 24, 1990 states that the fuel tank had been out of service since March 1981, and that no fuel had been purchased or pumped from the tank since that time. A Closure Report states that the tank was removed on May 25, 1995. The 1000 gallon steel tank was installed in 1956, but was out of use since 1981. An additional letter from March 12, 1998, shows that Caldwell Environmental Associates went on site to excavate near a vent pipe on the subject property, but that they could not find the UST. It was determined that the UST had been previously removed. (Appendix L). In addition, 12 UST facility sites were found on the OCC database within 0.5 miles of the subject property. All three tanks were installed in 1978 and were temporarily out of use as of 1999. The tanks included one 500 gallon diesel tank, one 1,500 gallon gasoline tank, and one 2,000 gallon gasoline tank. · Wayne Ramery - no tanks are reported for this facility. · J Bruton Dx – no tanks are reported for this facility. · Harvey Deason Texaco – no tanks are reported for this facility. The facility was closed in 1980. · Creek County Hwy Dept Dist #1 – there are four tanks reported for this facility. Two tanks were installed in 1960. One 1,000 gallon tank with unknown contents and one 1,000 gallon gasoline tank. Both were closed in 1991 and are permanently out of use. Two other tanks were installed in 1976, one 10,000 gallon diesel tank and one 10,000 gallon gasoline tank. Both are temporarily out of use. 4.13 State Institutional Control/Engineering Control Registries The DEQ Institutional Control/Engineering Control Registry for Brownfields, Voluntary Cleanup program, Site Cleanup Assistance Program, and Superfund (Ref.18) was searched. There are no known Institutional Control/Engineering Controls in effect for this subject property. 4.14 State Voluntary Cleanup Sites The DEQ Voluntary Cleanup Program (VCP) database was searched for VCP sites within the required ASTM search distance of ½ mile of the subject property (Ref. 14). No VCP sites are located on or within ½ mile of the subject property. 4.15 State Brownfield Sites The DEQ Brownfield database was searched for Brownfield sites within the required ASTM search distance of ½ mile of the subject property (Ref. 14). No Brownfield sites were found on or within ½ mile of the subject property. 4.16 Oil and Gas Records The subject property is located in the SE ¼ of the SE ¼ of the NW ¼ and the NE ¼ of the NE ¼ and the SW ¼ of Section 34, Township 18 North, and Range 11 East of the Indian Meridian, lying North and West of the St. Louis and San Francisco Railway right- Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 26 of-way in Creek County, Oklahoma. DEQ performed a search of oil and gas records from the Oklahoma Corporation Commission’s (OCC) oil and gas records database. The subject property is in an area where there is a history of oil and gas development. Oil and gas records were searched to record the known history of well development on and near the subject property. A search area consisted of the subject property as described from the legal location above and the quarter, quarter, quarter sections directly above and up gradient of the subject property. No well records were found in adjacent areas. Search results for wells near the area are located in Appendix L. 4.17 State Environmental Complaints and Local Services Response The DEQ State Environmental Complaints and Local Services database was searched for the subject property. No complaints have been reported for the subject property (Appendix N). 4.18 Dry Cleaner Databases The DEQ databases for dry cleaners (Ref. 19) and yellowpages.com (Ref.20) was searched for dry cleaners in the City of Sapulpa. One active dry cleaner was found with a one mile radius. Seven historic dry cleaners, located at unique addresses, were found within the search radius of 1.0 mile. Rachel Francks and Franziska Landes of the DEQ met the caretaker of the subject property, Ted Fischer, Director of Economic Development for the City of Sapulpa and Larry Prescott, former Recruiter at the Sapulpa Armory and were escorted to the subject property. Larry Prescott has been involved with the armory building extensively and served as the Recruiter at the Sapulpa Armory and served in the Oklahoma Army National Guard before that. He was active at the Sapulpa Armory from approximately 1964 to 1996. Larry Prescott answered questions to the best of his knowledge on the subject property. Mr. Prescott led Francks and Landes inside the building and gave his knowledge about what the building was used for and what kinds of activities occurred there in the past. All areas of the building were observed noting any environmental conditions that might need additional investigation. The entire outside area of the armory was walked around for observations that might need additional investigation as well. 5.2 General Site conditions The former Sapulpa Armory property (subject property) is composed of a brick building of approximately 9,880 square feet that was built in 1948 and does not contain a formal indoor firing range (IFR). The building is currently unoccupied, although some storage boxes from the City of Sapulpa were observed inside the building. The northern part of the building includes the drill floor that was also used as an unofficial indoor firing range. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 28 The southern part of the building includes mainly rooms used for office space and storage space. The property surrounding the building consists of residential area to the west, beyond which is a wooded area and Rock Creek; a gravel and sand storage area from the City of Sapulpa to the north; a City of Sapulpa motor pool and vehicle maintenance area to the northeast, beyond which is an industrial area; a railroad and Route 66 to the east and to the south; to the south of which is more industrial area. The subject property is on the west side of town along the railroad tracks in an area that was and is the industrial area of Sapulpa. Paved streets are located to the west and north of the subject property and a railroad runs along from the southern border of the subject property to the northeast. The following are general site conditions that were evaluated on the subject property and adjacent properties. 5.2.1 Aboveground Storage Tanks (ASTs) No ASTs were found on the subject property during the site reconnaissance. 5.2.2 Landfills and/or Dumping No landfills, dumping, or severely disturbed soil were found on the subject property. 5.2.3 Impoundments No impoundments were observed at the subject property. Drainage from the street and property to the north would follow the slope down to the armory and may pool on the north side of the armory building. The subject property used to have a waste water lagoon onsite directly to the east of the former armory building. 5.2.4 Monitoring Wells No monitoring wells were observed on the subject property. See Section 3.11.3 and Appendix M for monitoring wells found on adjacent properties in a search of the Oklahoma Water Resources Board records. 5.2.5 Disturbed and Stained Soils No disturbed or stained soils were noticed on the subject property. 5.2.6 Seeps No seeps of any kind were observed at the subject property. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 29 5.2.7 Chemical Spills No evidence of possible chemical spills was observed on the subject property. There were also no known chemical spills reported by the interviewee. 5.2.8 Farm Waste No farm waste was observed at the subject property. 5.2.9 Known Pesticide Misapplication No known pesticide misapplications were detected during the site visit or during the supportive research. 5.2.10 Discharges and Runoff from Adjacent Property Affecting the Site The former Sapulpa Armory is situated on a slope from north to south. The eastern side of the subject property also slopes a bit down to the east. Rainwater runs off the paved road and properties to the north onto the north side of the subject property, where it can pool. All other runoff not immediately to the north of the armory building would follow Sahoma Lake Road or topographic gradient to move past the subject property and further south or east. The property immediately to the north stores gravel and sand for the City of Sapulpa. The runoff from the subject property would follow the topographic gradient to the south or east. No other runoff from adjacent properties was observed. No potential pollutants were observed on the adjacent properties that may affect the armory. 5.2.11 Petroleum Products and Oil and Natural Gas Exploration No petroleum products or oil and natural gas exploration was observed during the site visit. 5.2.12 Asbestos Since many of the State armories were built before the 1970s, or used materials produced before the 1970s, there is a high potential of finding ACM in the armory buildings. The U.S. began banning the use of asbestos in most building products in the 1970s due to studies confirming the harmful health effects caused by exposure to airborne asbestos. ACM may be found in insulation wrapping of the heating pipes and/or heaters, roofing materials, ceiling tiles, window putty, mastic, and floor tiles. Floor tiles that are 9 x 9 inches have been found to regularly contain asbestos. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 30 DEQ’s contractor, GMR & Associates, sampled, analyzed, and assessed the armory for asbestos in February 2012. Non-friable asbestos was found in the mastic and floor tile in Room 14 and 16. The black mastic on the twelve by twelve inch brown floor tile in the hallway, covering approximately 380 square feet, was found to contain 5% and 7% chrysotile. The gray floor tiles covering approximately 250 square feet were also found to contain 10% chrysotile asbestos. The gray and white pipe insulation sampled was also found to have between 35% and 45% chrysotile asbestos. All other samples, including ceiling tiles, floor tiles, air duct mastic, drywall, carpet mastic, water elbows, and drywall dividers did not contain asbestos. DEQ collected a sample of a fallen ceiling tile on April 23, 2013 and analyzed it for asbestos. The fallen ceiling tile did not contain asbestos. The report from GMR & Associates and the lab results from the DEQ sampling are attached in Appendix O. 5.2.13 Lead DEQ has noticed the following common surfaces that have painted with lead-based paint in Oklahoma National Guard armories: doors, door frames, handrails, windows, window bars, wall trim, walls, overhead door frames, and downspouts in various places inside and outside of the building. GMR & Associates conducted a lead-based paint inspection of the former National Guard Armory building in February 2012. The lead-based paint inspection was conducted on the interior and exterior walls of the Former National Guard Armory building. The EPA’s threshold for lead-based paints is 1.0 mg/cm2. Lead-based paint was found in the ceiling of rooms 1 and 2 to contain between 5.6 mg/cm2 and 2.4 mg/cm2 lead. Lead-based paint was also found on the wall of room 19 at 2.3 mg/cm2, the exterior garage doors at 1.6 mg/cm2 to 4.3 mg/cm2, and exterior porch beam and ceiling at 2.1 mg/cm2 and 2.9 mg/cm2 respectively. No other areas that were surveyed tested positive for lead-based paint. The report from GMR & Associates is attached in Appendix O. GMR & Associates Inc. completed a Survey for Lead in Settled Dust of the former National Guard Armory building in February 2012. The EPA/HUD recommended maximum concentration for lead in settled dust is 40 micrograms per square foot (μg/ft2) for floors and 250 micrograms per square foot for window sills. Lead concentrations in settled dust exceeded these recommendations in the floor of Room 2 (71.6 μg/ft2) and on the window sill of Room 11 (421 μg/ft2). The report from GMR & Associates is attached in Appendix O. There is no IFR and associated vent fan in this building, so DEQ did not conduct any soil sampling. DEQ normally conducts soil sampling outside the vent fan of the IFR. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 31 5.2.14 Transformers/PCB Equipment Fluorescent lighting ballasts were found throughout the entire building. It is unknown if the ballasts contain PCBs. None of the ballasts appeared to have leaks. There were two pole-mounted transformers observed around the subject property, one noted to the west and one noted to the south of the subject property. It is unknown if the transformers contain PCBs, but they appeared to be in good condition. No other Polychlorinated biphenyl (PCB) contamination or other PCB-containing equipment was observed at the subject property. 5.3 External Observations The exterior of the building appears to be in good condition. The armory is currently unoccupied. There were no recognized issues with the exterior of the building. Directly to the east of the armory building there is a grassy area that is the location of the former waste water lagoon. This waste water lagoon is considered a historical recognized environmental condition (HREC). Photographs of the external view of the subject property can be found in Appendix B. 5.4 Internal Observations The building was last used by the Oklahoma Army National Guard and has been unoccupied for about a year. The one story building was constructed from brick in 1948. Before construction of the armory building, the land was owned by the Miller Pump and Supply, who bought the subject property in two sections from J. and M. Boccox and J. and Fife. During the site visit on April 23, 2013 the following issues were noted: chipped floor tiles, ceiling damage and fallen roof pieces in the drill floor and motor pool room, water damage/staining in the drill floor, wall damage, and window-sill damage. No chemicals or military equipment except for fire extinguishers were observed on the subject property. Photographs of the internal view of the subject property can be found in Appendix B. A map of the structure is included in Appendix F with notes taken by Franziska Landes during the site visit on April 23, 2013. 5.5 Interviews Former Recruiter and guard at the Sapulpa Armory, Larry Prescott, provided historical and environmental information about the subject property. He has been involved with the armory building extensively and served in Sapulpa Armory from approximately 1964 to 1996, and is, therefore, a good point of contact for knowledge of the building. He was not aware of any present environmental concerns on the subject property or adjacent properties. Below is the information obtained from Larry Prescott (Appendix B). Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 32 · There has been no industrial use of the subject property. The surrounding properties to the north, east, and south are part of an industrial park. The property to the north is a gravel and sand storage area, to the south and southeast is the railroad, and there is a material storage plant and collet plant. · Mr. Prescott knows of no chemical spills on the subject property. To his knowledge, the only chemicals used at the facility were solvents and cleaning materials used for weapon maintenance, gun oils, and motor oils. Chemicals were kept in the connex, a large metal cargo container. · Mr. Prescott is not aware of any oil exploration on the subject property or nearby. · The City of Sapulpa wants to use the building for an animal shelter. · The building did not have a formal indoor firing range, but the drill floor was used as an indoor firing range. Ammunition used included blanks and 22 caliber short range. They stopped using the drill floor as an IFR in the 1980s. · The subject property used to have a waste water treatment lagoon to the east of the armory building that has since been filled in. · There was one spill of a 55-gallon oil drum on the adjacent property to the north. EPA came out and made them dig out the spill area twice. · Mr. Prescott does not know of any hazardous air emissions on the subject property or nearby. · There was one underground storage tank that was used on the subject property in the past. Mr. Prescott is not aware of any above ground storage tanks used on the subject property. · Mr. Prescott does not know of any fill dirt, radiation signs, groundwater or surface water contamination nearby, discharges of runoff from nearby properties, and vent pipes or fill pipes, environmental lawsuits, liens or violations, wastewater discharge, unusual odors from soil, structures, or drains in the area or on the subject property. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 33 6.0 FINDINGS Summarized below are the major findings from this Targeted Brownfield Assessment and DEQ’s recommendations. The major findings of the highest environmental concern are presented first. · Other suspect ACMs, such as the ceiling tiles, were found to not contain any ACM, and are, therefore, not an issue. · There was one underground storage tank (UST) on the subject property. It had a 1,000 gallon capacity and was used to store gasoline. The tank was closed in 1981 and was removed in 1995. During the site visit on April 23, 2013, there was no sign of the UST or soil staining, and the pump island had been removed as well. The UST is considered a historical recognized environmental condition (HREC). · Seven historic dry cleaners were found within one mile of the subject property. One currently operating dry cleaner was found within a one mile radius of the subject property. It is unknown whether the dry cleaners are upgradient of the subject property, but it is possible based on the surface topography. The dry cleaners are considered a potential environmental concern (PEC) according to ASTM E 1528-06. · A former waste water lagoon was on the subject property directly to the east of the armory building. The lagoon had received various Notices of Violation from the Oklahoma Department of Environmental Quality. There was also a 1500 gallon septic tank on the subject property, and a 750 gallon septic tank that was abandoned in place in 1988 and not removed. A Memorandum dated January 9, 2001 states that the abandoned tank most likely contains liquid/sludge.The former waste water lagoon is considered a historical recognized environmental condition (HREC). · The former Sapulpa Armory was built in 1949. The land for the building was deeded by the Sapulpa Chamber of Commerce to the State of Oklahoma, on May 10, 1949 to the State of Oklahoma acting as a trustee for the Oklahoma National Guard. The subject property was managed and maintained by the Oklahoma Military Department (on behalf of the State of Oklahoma) until December 21, 2011 when the subject property was transferred to the City of Sapulpa. The subject property is currently owned by the City of Sapulpa, and the city is working to redevelop the subject property for use as an animal shelter. A Memorandum of Agreement (MOA) has been signed between the City of Okemah and the Oklahoma Department of Environmental Quality on September 6, 2011 (Appendix H). Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Creek County Courthouse. Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 34 · There is one large building on the subject property. Office space in the south part of the armory building, and a drill floor and motor pool room are in the northern part of the structure. No official indoor firing range (IFR) is present on the subject property; however, interviews with site representatives revealed that the drill floor was sometimes used as a make-shift IFR. All equipment has been removed with the exception of a few heating and cooling units and a water heater. · Adjoining properties consist of the following: a gravel and sand storage area to the north, and residential area to the north of that; the Creek County District #1 county barn to the northeast; a railroad and Route 66 to the southeast and south; commercial area to the south past Route 66; the Sapulpa Golf Course to the southwest; and residential area to the immediate west, and further west is Rock Creek. The subject property is situated along the railroad tracks, and further to the northeast there has been heavy industrial development, including an oil distributer, a glass manufacturing plant, and a brick plant. · The subject property is located on the western side of the City of Sapulpa. Sanborn Fire Insurance maps do not show a detailed view of the subject property until 1961, at which point the armory building is present. Adjacent properties contained industrial and commercial buildings including the Hastings Gasoline Company, Sapulpa Brick Plant, and the Miller Combination Bailer & Pump Company. Historical aerial photographs show the various stages of the industry surrounding the subject property. The aerial image from 1941 shows mainly vacant land immediately surrounding the subject property, although industrial development is visible to the northeast of the subject property, and residential development is seen to further to the north and west. Aerial images from 1961 onward show dense industrial and commercial development to the north, east and south of the subject property. A search through county records shows that the first deed transaction on the southern portion of the subject property was in 1904 when the portion was allotted from the Muskogee (Creek) Tribe of Indians, in Indian Territory to heirs of Polly Spocogee. The first deed transaction on the northern portion of the subject property was found in 1942 when the Miller Sand Pump company sold the portion to Russell Beaty. It is unclear what development, if any, the Miller Sand Pump company had on the subject property, but one small building was visible in Track Lot C in the Sanborn map of 1921. · No National Priority List (NPL) sites, deleted NPL sites, archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) sites, Resource Conservation and Recovery Act (RCRA) subject to corrective action (CORRACTS) sites, RCRA non-corrective actions (non- CORRACTS) treatment, storage, and disposal (TSD) listings, Emergency Response Notification System (ERNS) listings, Institutional Controls/Engineering Controls, RCRA generators, Voluntary Cleanup (VCP) sites, Brownfield sites, or State landfills and/or solid waste disposal sites were found on the subject Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 35 property or within ASTM recommended search radii. The subject property is on the DEQ SCAP list for cleanup of lead and asbestos contamination. · A search for leaking underground storage tanks (LUSTs) with the ASTM search radius shows 61 LUSTs within 0.5 miles of the subject property. It is unknown whether the LUSTs are upgradient of the subject property, but it is possible based on the surface topography. · There was no record of oil and gas production on the subject property or adjoining properties in the OCC oil and gas records. · Several pole-mounted transformers were noted to west and south of the armory building. It is unknown if they contain polychlorinated biphenyls (PCBs). Fluorescent lighting ballasts are located throughout the offices, storage rooms, kitchen, and restrooms in the main armory building as well as throughout the motor pool building. The lighting ballasts all appeared to be in good condition. All fluorescent bulbs contain mercury and should be handled as Universal Waste unless documentation and/or sampling demonstrate they are not hazardous 7.0 OPINION AND RECOMMENDATIONS Due to the past use of the subject property and the contamination found on the subject property, it is believed that cleanup of lead and asbestos will be necessary. 8.0 DATA GAPS No tribal information was obtained for this assessment. No tax records, city directories, or zoning records were reviewed for this report. A data gap exists from the aerial photos between 1941 and 1969, and between 1969 and 1995. Since the subject property does not appear on Sanborn maps, there is no direct knowledge of what occurred on the subject property until 1961 other than what is shown in aerial photographs and topographic maps. However, this did not affect the ability of the DEQ to make a recommendation on the subject property. 9.0 CONCLUSIONS We have performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-05 of the Former Sapulpa Armory located at 13 Sahoma Lake Road, Sapulpa, Creek County, Oklahoma. Any exceptions to, or deletions from, this standard are described in Section [11.0] of this report. This assessment has revealed no evidence of recognized environmental conditions in Phase I TBA Former Sapulpa Armory Sapulpa, Oklahoma 36 connection with the subject property except for the following: lead dust, lead-based paint, and asbestos contamination throughout the building. The information provided in this assessment is to assist the City of Sapulpa in its revitalization planning as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund – Ref. 2), as provided in the Small Business Relief and Brownfields Revitalization Act of 2002 (Public Law 107-118, Subtitle B – Ref. 3). 10. ADDITIONAL SERVICES In addition to this Phase I Targeted Brownfield Assessment, DEQ has provided sampling analysis of potential asbestos, lead-based paint, and lead dust sources. The DEQ Site Cleanup Assistance Program is in charge of identifying environmental hazards and conducting the cleanup of lead and asbestos at the Armory. 11. DEVIATIONS The following deviations from ASTM Practice E 1527-05 occur in this Phase I Targeted Brownfield Assessment. No tax records, city directories, or zoning records were reviewed for this report. The ASTM Phase I Environmental Site Assessment E 1527 – 05 is the minimum standard for environmental due diligence in the commercial real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfields Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the redevelopment project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area.
